The building is arranged over three floors and more precisely comprises:
- ground floor: multi-purpose cellar, cellar, laundry room as well as the common stairwell providing access up to the second floor
- second floor: living room-kitchen, hallway, bathroom and two bedrooms
- on the third floor, in the portion of exclusive ownership, there is an attic room
On the third floor there is a portion of attic in co-ownership comprising four rooms (hallway, attic, storage room and study). These rooms were and
are accessible only by passing through the portion of the apartment owned by the bankrupt party located on the third floor. These are enclosed rooms, therefore in the deed of purchase,
no right of way easement was declared.
It should be noted that no written agreement has ever been drawn up between the parties regarding the execution of the works to provide specific consent and, on the other hand, the other party has never contested the execution of the works by alleging a violation of its rights.
In the appraisal of the asset, considering that in order to take possession of the entire real estate unit it will necessarily be necessary to acquire the attic of common ownership through
adverse possession (usucapione).
The property is partly in unfinished (shell) condition and partly finished. The temporary electrical and plumbing/heating systems are present only in the rooms on the ground floor and lack declarations of conformity.
There are discrepancies/non-compliances.
Please note that:
- in the presence of multiple valid bids submitted at the auction base price, priority will be given to the bidder who has submitted an offer on both lots;
- if no offers are received on both lots at the base price but offers are received on both lots at the minimum offer, priority will be given to the offer submitted for Lot 1 at the base price;
- if there are no offers on Lot 1 at the base price, priority will be given to the bidder who has submitted an offer equal to the minimum offer on both lots.
In any case, the Procedure reserves the right to evaluate the offers received and may decide, at its sole and unquestionable discretion, to accept or reject the offers submitted in accordance with the best interest of the Procedure itself. In the event that the submitted offer is rejected, the bidder may not make any claim for damages or compensation.
