At present the building complex is presented in a rustic condition in a construction site condition and consists of n. 7 buildings (out of a total of 13) at various stages of progress.
Below is a brief description of the state of progress found during the accesses carried out by the estimator:

In relation to the primary urbanization works serving the architectural system, the same are only partially carried out: in this regard, please refer to specified in the estimate report drawn up by Eng. Alessio Melis on 3/11/2021.
The designed lots are characterized by both the same type plan and the same finishes.
In particular, the project envisages, for each typical lot, buildings with two elevations outside with pitched roofs, in some of which there have been phenomena of partial abandonment of the teguminous mantle.
As reported, each designed building houses four distinct real estate units on two elevations above ground, each of which, with an exclusive appurtenant space on the ground floor.
The investigations conducted by the appraiser revealed the absence of all the cadastral plans relating to the real estate units identified in the buildings register; this will make it necessary to improve and verify the cadastral documentation.
It should be noted that, as specified in the report drawn up by Eng. Alessio Melis on 22/1/2021, on parcels 1096 and 1120, owned by the bankrupt company, there are building artifacts available to third parties.
In particular, these are:
- a precarious structure used as a commercial space, built and occupied by virtue of a non-enforceable title to the Curatorship;
- portion of votive chapel.
All as better described in the attached appraisal.

- Rustic plots, bordering and/or facing the Anime Sante Construction Plan, located in the territory of the Municipality of Portopalo di Capo Passero (SR), mainly downstream of via Vincenzo Bellini (also known as via Anime Sante), extended overall cadastral ha 07.02.08, registered in the Land Registry of the Municipality of Portopalo di Capo Passero on sheet 42 parcels 1472, 400, 401, 402, 403, 404, 405, 406, 407, 408, 1024, 1027, 1028, 1030, 1032, 1034, 1036, 139, 245, 248, 251.
It should be noted that from the examination of the report it emerged that the aforementioned funds have a prevalent urban destination "E" in residual part for Viability - Parking where there are various urban planning constraints including, for part of the funds, the non-building limit pursuant to Regional Law 78/76; please refer to the certificate of urban destination issued on 10/27/2021 (it is represented that with certified email dated 4/18/2023, for which the Municipality of Portopalo di Capo Passero communicated with certified certified email dated 4/18/2023 that " the urban planning destinations indicated in the CDU of 27/10/2020 to date are unchanged").

It also should be noted that with the provision of 4/17/2020, amended by the provision of 8/5/2020, the Municipality of Portopalo di Capo Passero has ordered the extension, of the original concession title, of twenty months from the date of the transfer of the real estate compendium has taken place.

- that, pursuant to and for the purposes of art. 45 L. F., the aforementioned contract is not transcribed;
- that the Trustee, subject to authorization from the CoC, in appearing in the aforementioned proceedings, will declare his desire to dissolve pursuant to art. 72 L. F. from the contract for the hypothesis in which he were to attribute to the same a mandatory nature;
- that the Curatorship has notified the notice of sale to the plaintiff and that the latter has not lodged any appeals against the aforementioned notice.
