Deposit

The present auction is subject to a specific deposit for each single lot. The amount due is indicated in the lot webpages.

Lot 0 requires a deposit of EUR 620,00.

The deposit must be made via bank transfer to the account specified below:

Reference: auction number and lot number

Interested users must make the deposit described above before the end of the auction. Only once the deposit is received will the user be authorized to participate in the auction. To expedite participation in the auction, it is recommended to send proof of payment to info@gobid.es.

Users who participated in the auction but did not win any items will receive their deposit within 20 working days from the conclusion of the auction.

If, after making the deposit and winning the lot, the bidder does not complete the acquisition by paying the sale price and the Buyer's Premium, the deposit will be retained. In this case, the lot will not be assigned to the next highest bidder, but a new auction will be held under the conditions set by the Insolvency Administration.

Encumbrances

The sale of goods is carried out free of encumbrances and charges. However, all legally applicable taxes, fees, and duties related to the award, sale, or transfer of each asset will be borne by the winners or buyers.

Awarding of Lots

The sale will be conducted without a minimum price, although the Insolvency Administration reserves the right to reject the highest offers if considered insufficient. For accepted offers, the specialized entity will send provisional award confirmation to the winner, who will be obliged to pay the offered amount.

Warning: the Insolvency Administration reserves the right to inform the Court of the winning offer for approval. In this case, only once the offer is approved by the Court will the award confirmation be sent to the highest bidder with payment instructions within the specified timeframes.

Payment Method

All payments must be made entirely by bank transfer using the accounts communicated at the time of registration or along with the award notification (see general auction conditions).

Payment Deadline

The payment of the awarded lot price must be made within 10 days from the award notification.

The Buyer's Premium must be paid within 5 days from the award notification.

Collection Conditions:

The collection of the awarded lots by the buyer can take place only after the payment of the amounts due relating to the lots awarded and the foreseen commissions (Buyer's Premium, additional management fees).

In any case, the collection should absolutely be done before and no later than 20 days from the provisional award.

In order to optimize the collection service, GOBID ESPAÑA S.L will communicate via e-mail to the successful bidders the date (s) and a time during which they can proceed with the collection of the lots. These dates may also be indicated on the auction web page. In any case, GOBID ESPAÑA S.L can change the dates and times of collection indicated at its sole discretion.

In the event that the successful bidder should carry out the withdrawal on later dates, he will have to pay a fee between EUR 250.00 and EUR 350.00 plus VAT per day per operator, depending on the size of the goods to be retire, as additional skills.

The successful bidders will be required to respect the start date of operations. In the event that the successful bidder cannot arrange for collection on the day and time communicated, the successful bidder may:

- subject to approval, request to be admitted during the scheduled date (s) for the next sales experiment, when present.

- upon approval, carry out the collection on days and times other than those made available for the single experiment, paying an additional fee between EUR 250.00 and EUR 350.00 plus VAT per day per operator, depending on the amount of goods to be collected, as additional skills.

Failure to comply with an unscheduled collection date agreed between GOBID ESPAÑA S.L and the successful bidder, this one will result in the application of a penalty of EUR 350.00 if the non-collection is not notified at least 48 hours before the appointment, without prejudice, in any case, to compensation for the greater damage suffered by GOBID ESPAÑA S.L.

All lots not collected by the deadline will be subject to a daily default of EUR 50.00. In the event that the goods are not collected within 30 days from the deadline for collection, the sale will be considered automatically resolved and the amounts paid by the successful bidder (Lots Awarded - Buyer's Premium), will be retained as a compensation penalty.

GOBID ESPAÑA S.L is not required to deliver any lot or to organize in any way the collection and delivery of the same.

The collection operations must be carried out by the buyer in compliance with the current safety regulations established by law; the same will therefore be required to make the necessary adjustments in this sense also in reference to any third parties and / or collaborators employed in carrying out the operations.

The buyer is responsible for any disassembly, handling, loading and transport of the awarded lots and, in the case of registered movable property, for handling the paperwork required to carry out the necessary changes of ownership

The transfer of ownership must therefore be carried out by and at the expense of the successful bidder at the practice’s agency self-communicated by the Bodies of the Procedure, or alternatively, communicated by GOBID ESPAÑA S.L.

In case of export of registered movable property, the buyer must perform the required operations in compliance with current legislation.

In any case, GOBID ESPAÑA S.L will not make any lot available before the aforementioned payments have been credited and, in the case of registered movable goods, before the completion of the related transfer of ownership.

Other Specific Conditions

Buyer's Premium: a charge of 5,00% (plus 21% VAT, if applicable) of the award price of each lot, which will be added to it. The Buyer's Premium will have a minimum amount of 50 euros (plus 21.00% VAT, if applicable) per awarded lot or combination (minimum commission).

Award Taxes:VAT and/or all those taxes that are applicable according to the legislation and the successful tenderer will be applied.

Extra-Time: In the event that a bid is placed in the last 5 minutes, the period will be extended by an additional 5 minutes, and the countdown will restart until no bids are placed in the last 5 minutes of extra-time. In the case of a maximum bid (proxy bid), automatic increments will be considered valid for extending the extra-time period.

Bids for Complete Lot: In auctions with an option to bid for the complete lot (lot 0), participants can also place bids on individual lots and/or combinations of lots, but bids for the complete lot will be given preference. If the total of the winning bids on individual lots exceeds the complete lot, the Insolvency Administration will decide whether to proceed with awarding the individual lots or the complete lot. If no bid is received for the complete lot (Lot 0), the individual lots and/or combinations of lots will be awarded.

The sale of goods will be conducted according to their current condition, both in terms of physical configuration and legal status. It is recommended to visit the lots for sale.

All costs arising from the disposal will be borne by the winning party, including removal and transport costs, any property transfer costs, notarial deed, and any cancellation in any public register of the charges or encumbrances established on them.

No warranty for non-conformity of the goods is provided after the sale, so no claims for indemnification or compensation will be accepted from any purchasers or interested parties.

Therefore, any damages or lack of quality in the sold goods will not give rise to any extrajudicial or judicial action for indemnification or compensation.

Any liability of the Agent concerning the existence of third-party rights on the sold goods is excluded.

The sale is conducted with the buyer's obligation to bear their own costs and responsibility for verifying the actual conformity of the goods offered for sale.

Any liability of GOBID ESPAÑA S.L for errors or inaccuracies in the translation of texts and materials published on the website is excluded.

Ofertas sobre Lote Completo : En caso de que no se reciba oferta sobre el lote completo (Lote 0), se adjudicarán los lotes individuales y/o combinaciones.En el caso de que se reciban ofertas sobre el lote completo (Lote 0), los órganos del Procedimiento al final de la subasta se reservan el derecho de adjudicar o no este lote en función de los valores alcanzados por los lotes individuales.
