Deposit

The present auction is subject to a deposit of  EUR 50.000,00.

Deposit has to be paid in one of the following ways:

Lot availability

Within the peremptory term of 10 (ten) days from the date of the provisional award, further irrevocable purchase offers may be presented but they will not be effective if the price offered does not exceed by at least 10% the price for which the provisional award took place and they will not be accompanied by a deposit equal to 10% of the offered price. In this case, pursuant to art. 107, 4th paragraph of the LF, there will be no definitive award and a new sale will proceed with the competitive auction formula, with the base price equal to the new increased offer and a duration to be fixed in any case not less than 30 (thirty) days and governed by a new and separate notice of sale which will be immediately published.
If no increase offer is presented within the aforementioned ten-day term, the final award will be carried out.
In any case, the Delegated Judge, up to the date of completion of the sale, may with his decree suspend or revoke the sale operations when he deems that the allotment price is considerably lower than the fair one in accordance with the provisions of art. 108 FL.


Payment deadline

Awarded lots have to be paid in full within 60 days from the awarding.

Buyer's premium due has to be paid within 10 days from awarding.

Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 60 days from awarding to the extent that will be promptly disclosed.

In the event of non-fulfillment of any of the obligations incumbent on the same and as indicated above, the successful tenderer will be declared forfeited from the award, the deposit will be retained as a compensation penalty, the lot will be on sale again, subject to the consent of the Procedure bodies ; the original bidder may be sentenced to pay the difference with respect to the price of the subsequent awarding (art. 587 of the civil procedure code).
 

Property transfer

The transfer of ownership will take place with a notary deed designated by the Procedure only after full payment of the hammer price, the expenses as indicated above and the Buyer's Premium.
The real estate is being sold free of mortgage registrations and foreclosure transcripts if existing at the time of sale, any foreclosure registrations and/or transcripts, and/or seizures, as well as expenses relating to any other encumbrances, will be canceled by expenses of the purchasing party and subject to a formality cancellation/release order issued by the Delegated Judge.
In the event of failure to complete the transfer of ownership, the sale will be considered automatically terminated and the amounts paid by the successful bidder as hammer price and Buyer's Premium will be withheld as a compensation penalty.
For anything not provided for here, the laws in force apply.
 

Buyer's Premium

A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law). 
 
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.

For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.


VAT: 
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)


In case of insurgency of  any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website  translated in different languages, it will be applied the Italian language version of such texts

Se informa que están en curso las operaciones de actualización catastral y, por lo tanto, en el momento de la transferencia de propiedad se asignarán números de subalterno diferentes. El inmueble de este lote ha sido arrendado a la Guardia de Finanza, Reparto Técnico Logístico Administrativo Emilia Romagna mediante contrato firmado el 5 de mayo de 2022, con una renta anual de 51.000,00 euros más IVA legal y actualizaciones ISTAT. Además, el comprador deberá reembolsar los gastos incurridos por el Procedimiento para las obras de adecuación de los locales requeridos por el Cuerpo de la Guardia de Finanza, por un total de 217.674,88 euros.
