Deposit has to be necessarily credited before the auction deadline.
As soon as the deposit will be received, the user will be immediately allowed to bid.

For auction participation user has to send an official proof of the security deposit payment with transaction number to the following address: info@gobid.it as well as a copy of a valid Identification document  assigned to the fisical person or the legal representative of the company registered to the auction and certificate of the company constitution (Visura Camerale)

In case participants will not award any lot, deposit will be refunded within 20 days from auction deadline, with no interests applied.

If, in case of awarding, after deposit payment, the bidder will not comply with the payment terms, the deposit will not be refunded.


Lots Awarding
 

Taking into account the nature of the goods offered for sale in the notice, it will be specified and adequately highlighted that the award must be considered provisional as the name of the bidder / participant is subject to the necessary checks by ANBSC in order to comply with the restrictions on the circulation of goods in word. Only upon the favorable outcome of the aforementioned checks, at the unquestionable and confidential evaluation of ANBSC, will it be possible to proceed with the payment of the price and the transfer of the goods that are sold where they are currently located at the expense and responsibility of the successful bidder.
Therefore, the final award report will be drawn up only after having acquired the anti-mafia documentation issued by the competent Prefecture - UTG, pursuant to Legislative Decree 159/2011, with negative results, as well as the documentation proving the payment of the full sale price. It will be the responsibility of ANBSC to communicate in writing the results of the aforementioned investigations.
The sale of the asset takes place in the state of fact and law in which it is located; any differences in value cannot give rise to any compensation, indemnity or price reduction. It will therefore be the responsibility of the interested parties to check the value of the property covered by this announcement well in advance. All sales costs (such as registration in public registers, any request for new registration papers or license plates, etc.), will be borne by the purchaser, under penalty of forfeiture of the award. The final award report, in favor of the highest bidder, identified as a result of the auction, can be drawn up only if, once the anti-mafia information has been acquired, it appears that the provisional successful bidder does not belong to any of the subjective categories in respect of which the sale is precluded. of the confiscated property 1.
From the date of transcription of the transfer of ownership, the prohibition of further transfer for 1 year operates, pursuant to art. 48, paragraph 12-ter, Legislative Decree 159/2011. For all that is not provided for here, the laws in force apply.
The successful bidder must submit, in addition to the identity document, the following documents:
- that no final conviction has been pronounced against him, a criminal decree has been issued which has become irrevocable, or a sentence for the application of the penalty upon request, pursuant to art. 444 of the Code of Criminal Procedure, for serious crimes to the detriment of the State or the Community that affect professional morality or a final judgment, for one or more crimes of participation in a criminal organization, corruption, fraud, money laundering, as defined by Community acts referred to in Article 45, paragraph 1, EC Directive 2004/18, in particular:
I. crimes, committed or attempted, referred to in articles 416, 416-bis of the criminal code or crimes committed making use of the conditions provided for in the aforementioned article 416-bis or in order to facilitate the activities of the associations provided for by the same article, as well as for the crimes, committed or attempted, provided for by article 74 of the decree of the President of the Republic October 9, 1990, n. 309, by article 291-quater of the decree of the President of the Republic of 23 January 1973, no. 43 and Article 260 of Legislative Decree 3 April 2006, no. 152, as attributable to participation in a criminal organization, as defined in Article 2 of the Council Framework Decision 2008/841 / JHA;
II. crimes, committed or attempted, referred to in articles 317, 318, 319, 319-ter, 319-quater, 320, 321, 322, 322-bis, 346-bis, 353, 353-bis, 354, 355 and 356 of criminal code as well as article 2635 of the civil code;
III. fraud pursuant to Article 1 of the convention relating to the protection of the financial interests of the European Communities;
IV. crimes, committed or attempted, committed for the purposes of terrorism, including international, and subversion of the constitutional order terrorist offenses or offenses related to terrorist activities;
See crimes referred to in Articles 648-bis, 648-ter and 648-ter.I of the Criminal Code, money laundering or terrorist financing, as defined in Article 1 of Legislative Decree 22 June 2007, no. 109 and subsequent amendments;
YOU. exploitation of child labor and other forms of trafficking in human beings defined by the legislative decree 4 March 2014, n. 24;
VII. any other crime from which, as an ancillary penalty, the inability to contract with the public administration derives;
- that there are no causes of forfeiture, suspension or prohibition against them provided for in Article 67 of Legislative Decree 6 September 2011, no. 159 or an attempted mafia infiltration referred to in Article 84, paragraph 4, of the same decree.

 

Lots Availability
 
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on buyer's expenses.

Any costs relating to the transfer of ownership, including any double passages and related charges, will be borne by the successful bidder

Payment Methods

All payments have to be made exclusively by bank transfer. Account details will be indicated whether at the time of registration or  in conjunction with the awarding statement (in a private message to the user mailbox). (see General Terms and Conditions)

Awarded lots have to be paid within 5 days from awarding


Collection conditions

 
The collection of the awarded lots by the buyer can take place only after the payment of the amounts due relating to the lots awarded and the foreseen commissions (Buyer's Premium, additional management fees).
 
In any case, the collection should absolutely be done before and no later than 30 days from the provisional award. 
 
All lots not collected by the deadline will be subject to a daily default of EUR 50.00. In the event that the goods are not collected within 30 days from the deadline for collection, the sale will be considered automatically resolved and the amounts paid by the successful bidder (Lots Awarded - Buyer's Premium), will be retained as a compensation penalty. 
 
GOBID INTERNATIONAL AUCTION GROUP SRL is not required to deliver any lot or to organize in any way the collection and delivery of the same. 
 
The collection operations must be carried out by the buyer in compliance with the current safety regulations established by law; the same will therefore be required to make the necessary adjustments in this sense also in reference to any third parties and / or collaborators employed in carrying out the operations.
 
The buyer is responsible for any disassembly, handling, loading and transport of the awarded lots and, in the case of registered movable property, for handling the paperwork required to carry out the necessary changes of ownership
 
The transfer of ownership must therefore be carried out by and at the expense of the successful bidder at the practice’s agency self-communicated by the Bodies of the Procedure, or alternatively, communicated by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
In case of export of registered movable property, the buyer must perform the required operations in compliance with current legislation.
 
In any case, GOBID INTERNATIONAL AUCTION GROUP SRL will not make any lot available before the aforementioned payments have been credited and, in the case of registered movable goods, before the completion of the related transfer of ownership.

 

Additional specific terms

Buyer's Premium: A charge of 10,00% + VAT will be added to the price of each awarded lot.


The Buyer's Premium will have a minimum amount of 25 € (+ VAT at 22% where applicable) of each of the lots awarded or combinations as minimum commissions.

Additional management fees: These are the ancillary costs entirely borne by the successful bidder, intended to cover the services and activities, performed and to be performed, necessary for the preparation, organization, and management of the sale of the goods at auction and subsequent adjudication phase. These expenses must be paid together with the payment of the buyer's premium due as per the provisional award confirmation that will be issued after the end of the auction. Where due, these charges will be indicated in the sheet of each lot.

VAT: Value Added Tax at a rate of 22,00% will be calculated on the awarding price and added to it. (where applicable)

Extra-Time
In case a winning offer will be submitted within 5 minutes before the auction deadline, the  time  to place another bid will  be extended for 5 more minutes from the last bid received. Every other winning bid submitted within 5 extra-time minutes, will extend the time for placing another bid for  5 more minutes from the last bid received and so forth.
Automatic overbids in case of maximum bid (proxy bid) are condisdered winnig bids as well.


Lots are sold as is. Viewing is reccomended.

The sale of the goods is forced (art. 2919 c.c.) it is arranged for goods as is , in the rule of law and fact. In the forced sale it is not valid the warranty for vices. It cannot be contested for damages (Art. 2922 c.c.).
 

The sale occurs with obligation for the user who award the lot to check of the compliance with safety norms
 

Consequently the existence of any defects or lack of quality of the lots sold or differences, they cannot give rise to compensation, bonus or price reduction.
 

It is excluded any responisibility of the Agent about the existence of rights of third parties on the goods subject of sale (Art . 2920 Civil Code) 


In case of insurgency of  any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website  translated in different languages, it will be applied the Italian language version of such texts
