Deposit
Participation in the collection is subject to the payment of a mandatory security deposit equal to 10% of the appraisal price.
The deposit must be paid by bank transfer to the following current account:
BANCO DE SABADELL, S.A
IBAN : ES24 0081 0682 4100 0189 4093
SWIFT/BIC: BSABESBBXXX
OWNER: GOBID ESPAÑA S.L.
Reason: sale number and lot number.
Only once the deposit has been received will the offer be considered valid.
To speed up participation, the user is advised to send a scanned accounting copy of the payment with the CRO code to: info@gobid.es.
If the participants in the collection do not win any goods, the deposit will be returned within 10 working days of the collection deadline, without interest.
If, in the event of an award, after having paid the deposit, the bidder does not complete the purchase, this deposit will be withheld.
Participation regulation
The sale will take place according to the following stages:
- Collection of irrevocable purchase offers (PHASE 1)
The collection will be performed using the following methods:
All potential bidders, with the exception of persons not permitted to sell by law, after registering on the website www.gobid.it, will be required to send an irrevocable purchase offer for a free amount, by filling in the participation form "Annex A ” (published online) and return it signed, for acceptance of the proposed conditions, to the following address:
info@gobid.es
together with the accountant of the transfer certifying the payment of the required security deposit.
The irrevocable purchase offers presented by the potential buyers must be accompanied by the payment of the security deposit required, the payment of which will itself constitute a formal commitment to purchase by the subscriber of each offer.
The best offer received at the e-mail address provided by the Assignee may be accepted by the Mandator who will be able to:
- Award the lot or lots directly, without going to phase 2 (online auction) subject to acknowledgment of the buyer's premium due to the Agent to be paid by the successful tenderer.
- Use the offer as the base price for carrying out a sales experiment through an online auction on the Gobid.es platform, based on the offer received and whose specific conditions are set out below.
The Mandator reserves the right, at its sole discretion, to accept or reject the irrevocable purchase offers presented by potential buyers. Offers that are not considered appropriate may, therefore, be rejected by the Mandator.
In the event of acceptance of the best offer, the Mandator will appoint the Assignee to carry out the subsequent sale, to be carried out by online auction on the basis of the best offer received and whose specific conditions are set out below.
The offers must be formulated according to the methods indicated in the attached offer form and must contain:
- the identification of the bidder, with the complete indication of the personal details and the details of a document
recognition, the indication of the tax code and, in the case of a married natural person, the property regime existing between the two spouses;
- the CCIAA certificate of the company or of the sole proprietorship and an identification document of the legal representative in the case of a legal person or of the owner in the case of a sole proprietorship;
- the price offered
Filling in the form will imply acceptance of the conditions of use of the www.gobid.it platform and of the general and specific terms of collection and any subsequent auction.
- Timed Auction exclusively online (PHASE 2)
In case of admission of one or more offers in the offer collection phase, which are not accepted directly, the Mandator will appoint the Mandate for the subsequent sale, using the offer received to be carried out on the Gobid Platform as the auction base and reserve price. eg.
This offer will be formalized by the Assignee, in the name and on behalf of the bidder, through an online bet on the platform, for an amount equal to the value of the aforementioned offer, while the other bidders will instead be invited to make a bid on the platform, according to the methods published online on the web page dedicated to the auction.
The Assignee will take care to inform all bidders in any manner whatsoever of whether or not they are the best bidders at the time of formalization of the aforementioned irrevocable purchase offer.
At the end of the auction, confirmation of the award will be sent to the highest bidder with instructions for making payments on time.
Payment method
All payments must be made exclusively by bank transfer. The details will be specified either at the time of registration or upon receipt by the user of the communication of the award (see general conditions).
Deadline for payment
The lots awarded by the user must be paid within 10 days of the end of the sale. (see general conditions of the auction)
Withdrawal of the awarded lots
The withdrawal of the lots awarded by the buyer can take place only after the effective collection of the payments of the hammer price and the expected commissions (Buyer's Premium, ancillary management charges).
In any case, the withdrawal must be completed no later than 20 days from the provisional award.
All amounts relating to ancillary management charges are to be considered net of VAT.
In order to optimize the collection service, GOBID ESPAÑA SL will inform the successful bidders by e-mail of the date/s and a time during which they can proceed with the collection of the lots. These dates may also be indicated on the auction web page. In any case, GOBID ESPAÑA SL reserves the right to modify the indicated collection dates and times at its sole discretion.
In the event that the successful tenderer has to make the collection on later dates than those communicated, the same will have to pay a fee between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the amount of assets to be collected, such as additional fees.
Successful bidders will be required to respect the start date of operations. In the event that the successful tenderer cannot provide for the collection on the day and at the time communicated, the same will be able to:
- subject to approval, apply to be admitted on the date(s) scheduled for the next sales experiment, if any.
- subject to approval, collect on days and times other than those made available for the individual experiment, paying an additional fee of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the amount of assets to be withdrawn, such as additional fees
Failure to meet the scheduled pick-up date between GOBID ESPAÑA SL and the successful tenderer will result in the latter being charged a penalty of EUR 350.00 if the missed pick-up is not notified at least 48 hours before the appointment, subject to in any case, compensation for the greater damage suffered by GOBID ESPAÑA SL.
All lots not collected within the aforementioned deadline will be subject to a daily fine of EUR 50.00. In the event that the goods are not collected within 30 days from the collection deadline, the sale will be considered automatically terminated and the amounts paid by the successful tenderer (Awarded Lots - Buyer's Premium, ancillary management charges and any additional fees paid), will be retained as a compensatory penalty.
GOBID ESPAÑA SL is not required to deliver any lot or to organize their collection in any way.
The withdrawal operations must be carried out by the purchaser in compliance with the current safety regulations established by law; the same will therefore be required to make the adjustments necessary in this sense also with reference to any third parties and/or collaborators employed in carrying out the aforementioned operations.
The purchaser is responsible for any disassembly, handling, loading and transport of the awarded lots and, in the case of registered movable property, for the handling of the paperwork necessary to carry out the necessary transfers of ownership.
The transfer of ownership must therefore be carried out at the contractor's care and expense at the practical agency communicated by the Proceeding Bodies
Other specific conditions
Consequently, the existence of any defects or lack of quality or discrepancies in the thing sold cannot give rise to compensation, indemnity or price reduction.
Buyer's Premium: A charge of 18.00% + VAT will be added to the clearing price of each lot.
The Buyer's Premium will have a minimum amount of €50 (+21% VAT where applicable), on each of the lots or combinations awarded, as minimum commissions.
Ancillary management charges: These are the ancillary costs charged entirely to the contractor, intended to cover the services and activities, performed and to be performed, necessary for the preparation, organization and management of the sale of the goods at auction and the subsequent award phase. These expenses must be paid together with the payment of the buyer's premium due as per the provisional award confirmation which will be issued after the end of the auction. Where due, these charges will be indicated in the file for each lot.
VAT: VAT at 21.00% of the sale price will be calculated on the clearing price of each lot. (where applicable)
Extra-Time: if a winning bid is made in the 5 minutes prior to the close of the auction, the time to place another bid will be extended by a further 5 minutes from the last bid received. Thus, to the bitter end, for each winning offer received within the 5 minutes of extra time, the time needed to make another offer will be extended by a further 5 minutes from the last bet received. Automatic raises in the event of a maximum bid (proxy bid) will also be considered winning bids.
The lots are sold as they are. Viewing is recommended.
The sale of the goods is arranged for the goods seen and liked in the state of fact and law in which they are found. The guarantee for material defects does not apply to the sale. It cannot be contested for damages.
Consequently, the existence of any defects or lack of quality or discrepancies in the thing sold cannot give rise to compensation, indemnity or price reduction.
Any liability on the part of the Assignee is excluded regarding the existence of third party rights on the goods being sold.
The sale takes place with the obligation and burden of the successful tenderer to ascertain their compliance with safety legislation.
