Participation in the collection is subject to the payment of a mandatory security deposit equal to 5% of the submitted offer.

The deposit must be absolutely accredited before the end of the offer collection.
 
If the participants of the auction do not win any goods, the deposit will be returned within 20 days from the deadline of the auction, without interest.
 
In the event of awarding one or more lots, the security deposit will be returned only after the buyer has made the withdrawal or transfer of ownership.
 
If, in case of award, after having paid the deposit, the bidder will not complete the purchase, said deposit will be retained.

Rules for participation
 
The sale will take place according to the following phases:
 
- Irrevocable purchase offer (PHASE 1)
 
The collection of irrevocable purchase offers will be carried out using the following methods:
 
All eventual bidders, except for the subjects by law not admitted to the sale, after having registered on the website www.gobid.es, will be required to send an irrevocable offer for free purchase, by filling in the participation form (published on line) and return it signed, for acceptance of the proposed conditions, to the following address:

together with the bank transfer accountant certifying the payment of the required security deposit.
 
The irrevocable purchase offers submitted by the eventual purchasers must be accompanied by the payment of the security deposit requested, the payment of which will constitute, itself, a formal purchase commitment by the subscriber of each offer.

Offers must be formulated according to the methods indicated in the attached offer form and must contain *:
 
- the identification of the bidder, with the complete indication of the details and the details of an identification document, the indication of the tax code and, in the case of a married person, under the legal community of property, the indication of the general information and the spouse's tax code.
- the company register of the company or the individual company and a document of identification of the legal representative in the case of a legal person or the owner of the individual company;

The completion of the form will involve the acceptance of the sales notice, of the conditions of use of the www.gobid.es platform and of the general and specific terms of the collection and of any subsequent auction.
 
The Mandator reserves the right, at its sole discretion, to accept or not the irrevocable purchase offers submitted by any purchasers below the reserve price.
 
In the case of an offer with an equal amount or higher than the reserve price, direct awarding will take place. In case of two or more offers with an amount higher than the reserve price, the highest bid received will be awarded.
 
Once the offer has been accepted by the provisional contractor, the award communication will be sent in writing by e-mail. The provisional borrower must then complete the acquisition by paying the sale price and the Buyer’s Premium in the terms established.
 
 
Offers that are not considered adequate can therefore be rejected by the Mandator, without costs for the Procedure
 
-Time exclusively online auction (PHASE 2)
 
In the case of more than one offer admitted, the best offer received by the email address provided by the Assignee can be used as an auction basis for a competitive sales experiment to be performed on the Gobid.es Platform.
 
This offer will be formalized by the Mandatory, in the name and on behalf of the bidder, through an online bet on the platform, for an amount equal to the value of the aforementioned offer, while the other bidders will be invited, instead, to make a raise on the platform, according to the procedures published online on the website dedicated to the auction.
For the purpose of identifying the best offer received, please refer to what is indicated in the notice of sale.
 
In the presence of a single offer at the end of phase 1 - collection of irrevocable purchase offers - the Mandator may reserve the right to award the lot or lots for sale directly, without opening phase 2 - upon recognition of the buyer's premium due to Authorized representative.
 
If the bidder, once declared the successful bidder by written communication, does not complete the acquisition by paying the sale price in the established period, the awarding of the lots in favor of the next best bidder who has submitted will be submitted at the discretion of the Mandate offer higher than the reserve price.
 

Payment method
 
All payments must be made exclusively by bank transfer. The details will be specified either at the time of registration or upon receipt by the user of the award communication (see general conditions).
 
Deadline for payment
 
The payment of the lots awarded must take place within 15 days from the dispatch of the notice of appeal.
 
The due buyer's premium must be paid within 5 working days from the award on the current account indicated by the Mandate.
 
Property transfer
 
The transfer of the property will take place only after the full payment of the adjudication price and the expenses due by notarial deed according to the methods established by the principal.
In the event of non-collection of the movable property within the expected time or completion of the transfer of ownership of the immovable property for reasons due to the contractor, the sale will be considered automatically terminated and the amount paid by the successful tenderer will be withheld as a compensatory penalty.
 
expenses
 
All charges and charges, taxes and duties related to the award of each lot that are legally applicable, will be charged to the successful bidders, who will also have to pay notary fees, registration fees and any other related costs with the award. In no case will neither the Mandator nor Gobid International Auction Group Srl bear any type of expense related to the award. Furthermore, the buyer will be responsible for all the existing suspended amounts relating to the taxes on immovable property and on those taxes and expenses accrued and unpaid that are imposed on the assets. Furthermore, to guarantee the obligation on the payment of taxes on the increase in the value of the Land (plusvalia) accrued, the contractor must deposit no later than the date on which the writing of the sale or transfer of ownership will be conferred, bank check of the amount of the survalia in favor of the Mandator.


Buyer's Premium: A charge of 10.00% + 22% VAT (if applicable) will be added to the hammer price of each lot.
 
Awarding Taxes: VAT and / or all those taxes that are applicable according to the law and the winning entity will be applied.
 
Extra-Time: if a winning bid is formulated within 5 minutes before the auction closes, the time to make another offer will be extended by a further 5 minutes from the last received bet. Thus to the bitter end, for each winning bid received within the 5 minutes of extra time, the time needed to make another offer will be extended by a further 5 minutes from the last received bet. Automatic bids in the event of a maximum bid (proxy bid) will also be considered winning bids.
 
Lots are sold as seen and enjoyed in the state in which they are found. Viewing is recommended.

All costs generated by the sale will be borne by the contractor, including the costs of collection and handling, any costs of transfer of ownership, notarial writing and any cancellation from any public register of the burdens on the specific asset.
 
The sale of the goods is intended as forced (Article 2919 of the Civil Code) for the goods seen and enjoyed in the state of fact and law in which they are located. In the forced sale the guarantee for the defects of the thing does not take place. It cannot be challenged due to damage. (Art. 2922 c.c.)
 
Consequently the existence of any defects or lack of quality or non-conformity of the thing sold cannot give rise to compensation, indemnity or price reduction.
 
Any liability to be borne by the Mandatory with regard to the existence of third-party rights on the goods subject to the sale (Art. 2920 c.c.) is excluded.
 
The sale takes place with the obligation and responsibility of the contractor to ascertain their compliance with safety regulations.
