Participation in the auction is reserved for residents of Italy.

Deposit

The auction is subject to a security deposit of EUR 200,00.

The deposit must be credited before the end of the auction.
Once the deposit has been credited, the user will be authorised to participate in the auction.
To expedite participation in the auction, the user is advised to email a scanned copy of the payment receipt, including the CRO code, to: [email protected]

If the auction participants do not win any lots, the deposit will be refunded within 30 working days of the auction closing date, without interest.

If, after paying the deposit, the successful bidder fails to complete the purchase, the deposit will be retained.

Availability of Lots

Any entries relating to pre-emption rights, registrations of attachments and conservatory seizures, and any other encumbrances on the assets offered for sale, will be cancelled pursuant to Article 108 of the Bankruptcy Law once the sale has been completed and the price has been paid in full. All formalities for cancellation will be carried out at the successful bidder's expense and under their responsibility.

All costs relating to transfers of ownership, including any multiple transfers and related charges, shall be borne by the successful bidder

Payment method

The balance of the price for the lots must be paid via pagoPA, using the instructions that will be provided at the end of the auction.

The Buyer's Premium must be paid exclusively by bank transfer. The payment details will be provided either at the time of registration or when the user receives notification that they have won (see the general terms and conditions).

Payment deadline

The successful bid price must be paid via PagoPA, in accordance with the instructions provided to the successful bidder, within no more than 5 days of the successful bid.

The Buyer's Premium, plus VAT, must be paid by the successful bidder within 5 days of the successful bid, together with any applicable additional management charges.

Collection of won lots
 
The buyer may collect the lots won only after payment of the successful bid price and the applicable commissions (Buyer's Premium and additional management charges) has actually been received.
 
In all cases, collection must be completed within 30 days of the provisional successful bid, and no later.
 
In order to optimise the collection service, GOBID INTERNATIONAL AUCTION GROUP SRL will notify successful bidders by email of the date(s) and time during which they may collect the lots. These dates may also be indicated on the auction webpage. In any case, GOBID INTERNATIONAL AUCTION GROUP SRL reserves the right, at its sole discretion, to change the stated collection dates and times.
 
If the successful bidder collects the lots on dates other than those communicated, they must pay an additional fee of between EUR 250.00 and EUR 350.00, plus VAT, per day, depending on the quantity of goods to be collected.
 
Successful bidders must comply with the scheduled start date for collection operations. If the successful bidder is unable to collect the lots on the notified date and at the notified time, they may:
 
-  subject to approval, request permission to collect during the date(s) scheduled for the subsequent sale attempt, if any.
 
-  subject to approval, collect on days and at times other than those made available for the individual sale attempt, upon payment of an additional fee of between EUR 250.00 and EUR 350.00, plus VAT, per day, depending on the quantity of goods to be collected.
 
Failure to comply with the collection date scheduled between GOBID INTERNATIONAL AUCTION GROUP SRL and the successful bidder will result in a penalty of EUR 350.00 being charged to the successful bidder if the failure to collect is not notified at least 48 hours before the appointment, without prejudice, in any case, to GOBID INTERNATIONAL AUCTION GROUP SRL's right to compensation for any greater loss suffered.
 
All lots not collected within the above deadline will be subject to a daily late fee of EUR 50.00. If the goods are not collected within 30 days of the collection deadline, the sale will be automatically rescinded and the amounts paid by the successful bidder (for the lots won, Buyer's Premium, additional management charges and any additional fees paid) will be retained as compensation by way of a penalty. 
 
GOBID INTERNATIONAL AUCTION GROUP SRL is not required to deliver any lots or to arrange their collection in any way. 
 
The buyer must carry out collection operations in compliance with the applicable statutory safety regulations; accordingly, the buyer must implement any necessary measures to ensure such compliance, including with respect to any third parties and/or contractors involved in carrying out those operations.
 
The buyer is responsible for dismantling, handling, loading and transporting the lots won and, in the case of registered movable assets, for completing the procedures required to carry out the necessary transfers of ownership. 
 
Transfers of ownership must therefore be carried out by and at the expense of the successful bidder at the vehicle registration agency indicated by the authorities responsible for the proceedings or, alternatively, by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
If registered movable assets are exported, the buyer must complete the required procedures in compliance with the applicable regulations.
 
In all cases, GOBID INTERNATIONAL AUCTION GROUP SRL will not make any lots available until the above payments have been credited and, in the case of registered movable assets, until the relevant transfer of ownership has been completed.
Other specific conditions

The successful bidder is required to remove the livery present on the vehicle being awarded and any equipment installed on it before using it. Collection of the lot is conditional upon signing a specific release declaration in which the successful bidder undertakes to remove the livery present on the awarded goods before using them and, in any event, within 10 days of collection, thereby holding the Municipality and/or Gobid International Auction Group s.r.l. harmless from any liability in this regard. The successful bidder must provide adequate documentation, including photographs, demonstrating that the livery and related equipment have been removed.

Buyer's Premium: A charge of 15,00% + VAT will be added to the winning bid price of each lot.

The Buyer's Premium will be subject to a minimum amount of €25 (+ 22% VAT where applicable) for each lot or combination awarded, as a minimum commission.

Additional management charges: These are additional costs borne entirely by the successful bidder, intended to cover the services and activities, performed and to be performed, necessary for preparing, organizing and managing the sale of the goods at auction and the subsequent award process. These charges must be paid at the same time as the buyer's premium due, as stated in the provisional award confirmation issued after the auction ends. Where applicable, these charges will be specified in each lot's description.

VAT: VAT NOT APPLICABLE

Extra Time: if a winning bid is placed within the 5 minutes before the auction closes, the time available to place another bid will be extended by a further 5 minutes from the last bid received. This will continue indefinitely: for every winning bid received within the 5-minute extra-time period, the time available to place another bid will be extended by a further 5 minutes from the last bid received.  Automatic bids placed when a maximum bid (proxy bid) is set will also be considered winning bids.

Lots are sold as seen and accepted in their current condition. Inspection is recommended.

The sale of the goods is a forced sale; the goods are sold as seen and accepted in their actual and legal condition. In a forced sale, no warranty is provided for defects in the goods. The sale may not be challenged on the grounds of damage.

Consequently, the existence of any defects, lack of quality or non-conformity of the goods sold shall not give rise to any compensation, indemnity or price reduction.

The Agent shall have no liability whatsoever with regard to the existence of third-party rights over the goods being sold. 

The successful bidder is responsible for and bears the cost of verifying that the goods comply with safety regulations.

In the event of any disputes concerning the interpretation of the provisions contained in the general and specific terms and conditions displayed on the platform, which may have been translated into other languages, the Italian version of the text shall prevail.
