By submitting the bid, the bidder declares that they have fully reviewed and fully accept these conditions of sale and all documentation made available. If there is a notice of sale attached to the auction/listing sheet, by placing the bid, the bidder declares that they have reviewed and accept the conditions set forth therein, with respect to which these conditions of sale are to be understood as an extract. The bidder further declares that they have examined and accepted all documentation made available for participation

Deposit

The auction is subject to a security deposit of EUR 200,00.

Lot 0 requires payment of a deposit equal to EUR 1.100,00

Lots with a starting value equal to or greater than EUR 3,000.00 require payment of a specific security deposit indicated in the relevant lot sheets.

The deposit must mandatorily be credited before the auction end term.
Once the deposit has been credited, the user will be enabled to participate in the auction.
To speed up participation in the auction, the user is advised to send a scanned accounting copy of the payment made with the CRO code to: [email protected]

If auction participants do not win any asset, the deposit will be returned within 20 business days from the final auction end term, without interest.

If, in the event of award, after paying the deposit, the bidder does not complete the purchase, said deposit will be retained.

Availability of Lots

Any registrations relating to rights of first refusal, transcriptions of foreclosures and conservatory seizures and any other restriction encumbering the assets offered for sale will be cancelled pursuant to art. 217, paragraph 2 C.C.I.I. once the sale has been executed and the price fully collected. Any formality for cancellation will be carried out by and at the expense of the successful bidder.

All costs relating to transfers of ownership, including any double transfers and related charges, will be borne by the successful bidder

In the event of export of registered movable assets, the purchaser must carry out the operations required in compliance with current regulations. Please note that for deregistration for export purposes, as of the date of the request, the vehicles must be up to date with the inspection obligations established by law.

Payment method

All payments must be made exclusively by bank transfer. The details will be specified either at the time of registration or upon receipt by the user of the award communication (see general conditions).

Payment deadline

Awarded lots must be paid within 5 days from confirmation of provisional award.
The Buyer's Premium and ancillary management charges, where provided, must be paid within 5 days from confirmation of provisional award.

Collection of awarded lots
 
Collection of awarded lots by the purchaser may take place only after actual receipt of payment of the award price and the applicable commissions (Buyer’s Premium, ancillary management charges).
 
In any case, collection must be completed within and no later than 30 days from provisional award.
 
In order to optimize the collection service, GOBID INTERNATIONAL AUCTION GROUP SRL will notify successful bidders by e-mail of the date(s) and a time during which they may collect the lots.  Such dates may also be indicated on the auction web page. GOBID INTERNATIONAL AUCTION GROUP SRL in any case reserves the right to change the indicated collection dates and times at its sole discretion.
 
If the successful bidder collects on dates other than those communicated, they must pay a fee between EUR 250.00 and EUR 350.00 plus VAT  per day, depending on the quantity of assets to be collected, as additional charges.
 
Successful bidders will be required to comply with the operations start date. If the successful bidder cannot collect on the communicated day and time, they may:
 
-  subject to approval, request to be admitted during the date(s) scheduled for the subsequent sale attempt, if any.
 
-  subject to approval, collect on days and times other than those made available for the individual attempt, paying an additional fee between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of assets to be collected, as additional charges
 
Failure to comply with the scheduled collection date between GOBID INTERNATIONAL AUCTION GROUP SRL and the successful bidder will result in the application to the latter of a penalty of EUR 350.00 if the failure to collect is not notified at least 48 hours before the appointment, without prejudice, in any case, to compensation for the greater damage suffered by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
All lots not collected within the term indicated above will be subject to a daily late fee of EUR 50.00. If the asset is not collected within 30 days from the collection deadline, the sale will be automatically terminated and the amounts paid by the successful bidder (Awarded Lots - Buyer’s Premium, ancillary management charges and any additional charges paid) will be retained as a compensation penalty. 
 
GOBID INTERNATIONAL AUCTION GROUP SRL is not required to deliver any lot nor to organize in any way their collection. 
 
Collection operations must be carried out by the purchaser in compliance with current safety regulations established by law; the purchaser will therefore be required to make the necessary adaptations in this regard also with reference to any third parties and/or collaborators employed in carrying out the aforementioned operations.
 
The purchaser is responsible for the possible dismantling, handling, loading and transport of the awarded lots and is required to leave the places involved in the collection in safe conditions and free of goods and/or waste materials produced by them during the aforementioned operations. In the case of registered movable assets, the purchaser shall be deemed responsible for handling the procedures required to carry out the necessary transfers of ownership. 
 
Transfers of ownership must therefore be carried out by and at the expense of the successful bidder at the motor vehicle registration agency communicated by the Procedural Bodies, or alternatively, communicated by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
In the event of export of registered movable assets, the purchaser must carry out the required operations in compliance with current regulations.
 
In any case, GOBID INTERNATIONAL AUCTION GROUP SRL will not make any lot available before receipt of the above payments and, in the case of registered movable assets, before completion of the relevant transfer of ownership.
Other specific conditions

Buyer's Premium: A charge of 12,00% + VAT will be added to the hammer price of each lot.

The Buyer’s Premium will have a minimum amount of 25 € (+ VAT at 22% where applicable), on each of the lots or combinations awarded, as minimum fees.

Additional management charges: They are ancillary costs borne entirely by the successful bidder, intended to cover the services and activities, performed and to be performed, necessary for the preparation, organisation and management of the sale of the auctioned goods and the subsequent award phase. These expenses must be paid at the same time as the payment of the buyer's premium due as per the provisional award confirmation that will be issued after the end of the auction. Where due, such charges will be indicated in the details page of each lot.

VAT: VAT at 22,00% of the sale price will be calculated on the hammer price of each lot. (where applicable)

Extra-Time: if a winning bid is placed in the 5 minutes before the auction closes, the time available to place another bid will be extended by a further 5 minutes from the last bid received. And so on, for each winning bid received within the 5 minutes of extra time, the time available to place another bid will be extended by a further 5 minutes from the last bid received.  Automatic bids in the event of a maximum bid (proxy bid) will also be considered  winning bids.

Bids on the Complete Lot: If no bids are received on the complete lot (Lot 0), the individual lots and/or combinations will be awarded.
If bids are received on the complete lot (Lot 0), the bodies of the Procedure at the end of the auction reserve the right to award or not award this lot based on the values reached by the individual lots.

The lots are sold as seen and approved in the condition in which they are found. Viewing is recommended.

Any adaptation of the goods to all applicable regulations and in particular to those on prevention, safety as well as those concerning ecological and environmental protection and – more generally – to applicable regulations shall be the exclusive responsibility of the buyer, who shall bear any expense, with the seller released from any liability in this regard. Any instrumental goods not complying with the regulations currently in force on the matter, where included in the inventory, will be considered subject to the sale solely as goods to be used as spare parts, with the exclusion of any liability of the Receivership for any use thereof by the buyer. In particular, for any goods not complying with safety regulations, lacking the CE mark, the successful bidder is obliged to proceed, at their sole care, expense and risk, to bring them into compliance or, if this is not possible, to dispose of them in the forms required by law.

The sale of the goods is deemed forced (Art. 2919 of the Italian Civil Code) and is arranged for the goods as seen and approved in the factual and legal state in which they are found. In a forced sale, the warranty for defects of the item does not apply. It cannot be challenged on grounds of damages. (Art. 2922 of the Italian Civil Code).

Consequently, the existence of any defects or lack of quality or non-conformity of the item sold cannot give rise to compensation, indemnity or reduction of the price.

Any liability on the part of the Agent is excluded regarding the existence of third-party rights over the goods subject to the sale (Art. 2920 of the Italian Civil Code).

The sale takes place with the obligation on the part and at the expense of the successful bidder to verify their compliance with safety regulations.

In the event of any disputes arising regarding the interpretation of the provisions contained in the general and specific conditions set out on the platform, possibly translated into other languages, the Italian version of the text shall prevail.
