Deposit

To participate in the Auction, it is necessary to pay a specific deposit for each lot.

Lot 0 requires a deposit of EUR 1.730,00
The deposit must be made by bank transfer to the account specified below:

Reference: sale number and lot number.

The offer will be considered valid only once the deposit is received.

Users who have participated in the collection of offers but have not been awarded any asset will receive their deposit back within 20 business days following the communication of the offer rejection or its expiration.

If, after making the deposit and being awarded the lot on sale, the bidder does not complete the acquisition by paying the sale price and the Buyer’s Premium, said deposit will be retained.

Awarding of the lots

At the end of the auction, if the winning bid is equal to or higher than the reserve price, an award confirmation will be sent to the highest bidder with instructions to make the payments within the scheduled deadlines. If the offer does not reach the reserve price, the award will be subject to approval by the property.

Method of payment

All payments must be made entirely by bank transfer using the accounts communicated at the time of registration or together with the award communication (see general auction conditions).

Payment deadline

Payment of the award price of the lots must be made within 10 days from the award communication.

Payment of the Buyer’s Premium must be made within 5 days from the award communication.

Conditions for the collection of the awarded lots

In any case, collection must be completed no later than 20 days from the provisional award confirmation.
In order to optimize the collection service, GOBID ESPAÑA S.L. will communicate by email to the successful bidders the date and time to proceed with the collection of the lots. These dates may also be indicated on the auction website. In any case, GOBID ESPAÑA S.L. reserves the right to change the dates and times indicated for collection at its sole discretion.

If the successful bidder needs to carry out the collection on dates other than those offered, they will have to pay an amount between EUR 250.00 and EUR 350.00 plus VAT for each added day, depending on the goods to be collected, as additional expenses.

Successful bidders must respect the proposed date. If you cannot make the collection on the communicated date and time, you may:
- Upon approval, request that collection be allowed on another date.
- Upon approval, carry out the collection on days and times different from those initially proposed in the same sale phase, paying a further fee of between 250.00 euros and 350.00 euros plus VAT per added day and person needed for assistance, as additional expenses.

Failure to comply with the scheduled collection date between GOBID ESPAÑA S.L. and the successful bidder will result in a penalty of 350.00 euros applied to the latter if they have not notified the cancellation of the collection at least 48 hours before the appointment, without prejudice to the fact that, in any case, compensation for damages must be paid to GOBID ESPAÑA S.L.

Lots not collected within the established period will be subject to a daily penalty of 50.00 euros. If the asset is not collected within 30 days after the last scheduled collection day, the sale will be considered resolved, and the amounts paid by the successful bidder (Awarded lots – Buyer’s Premium, complementary management expenses, and any complementary charges paid) will be retained as compensation for the prejudice caused.

GOBID ESPAÑA S.L. has no obligation to deliver any lot nor to organize in any way the collection and delivery thereof.

Collection operations must be carried out by the buyer in compliance with current safety regulations established by law; therefore, they will be obliged to make the necessary adjustments even when referring to third parties and/or collaborators employed in carrying out the aforementioned operations.

The successful bidder is responsible for any dismantling, moving, loading, and transporting of the awarded lots, and in the case of vehicles, also for the transfer of ownership and other corresponding procedures.

In any case, GOBID ESPAÑA S.L. will not make any lot available before the previous payments have been settled and, in the case of registered movable assets, before the corresponding transfer of ownership is completed.

Formalization and collection:
The successful bidder will be obliged to formalize the corresponding purchase contract within the period indicated by the auction management entity. Likewise, they must carry out, at their own expense and cost, all necessary procedures for the change of ownership of the awarded asset before the Directorate General of Traffic (DGT) and any other applicable public registries.
In the event that the collection of the asset takes place prior to the change of ownership, the successful bidder will assume from that moment all responsibilities, charges, expenses, taxes, and penalties that may arise from it, expressly exonerating the selling entity and the management entity from any liability subsequent to delivery.

Other specific conditions

Buyer’s Premium: a charge of 19,00% (plus 21% VAT, if applicable) on the award price of each lot, which will be added to it.

The Buyer’s Premium will have a minimum amount of 50 euros (plus 21.00% VAT, if applicable) for each awarded lot or combination (minimum commission).

Minimum Buyer’s Premium – Lot 0 and Lot 4

For Lots 0 and 4, a minimum Buyer’s Premium (BP) of €2,112 + VAT is established, calculated on the amount of the debt associated with the lot.
Likewise, a 19% + VAT BP will be applied to bids received on the Gobid portal, added to the indicated minimum amount.

VAT: 21.00% VAT on the sale price, which will be calculated on the award price of each lot (if applicable).

Lot 0 and 4 - Debt assumption and seizure cancellation

Lot 4 is subject to an administrative seizure in favor of the State Tax Administration Agency (AEAT) for the amount of €11,119.61.

The successful bidder will fully assume said debt, committing to pay the indicated amount directly to the AEAT, as well as to carry out the necessary procedures for the cancellation of the seizure encumbering the vehicle.

Consequently, the successful bidder expressly waives any claim against the seller or the auction management entity regarding this concept, accepting the asset in its current legal state.

Administrative expenses: These are the additional expenses that fall completely on the successful bidder, intended to cover the services and activities, performed and to be performed, necessary for the preparation, organization, and management of the sale of the assets at auction and the post-award phase. These expenses must be paid together with the payment of the buyer's premium according to the provisional award confirmation that will be issued once the auction is finished. If applicable, said expenses will be indicated in the file of each lot. In the event of awarding several lots, a reduction of said expenses may be agreed upon depending on the effective collection days and the service offered by Gobid.

Offers on the Complete Lot: In the event that no offers are received for the complete lot (Lot 0), the individual lots will be awarded, provided they have received offers, according to what is established in the paragraph "Awarding of the lots". In the event that offers are received for both the Complete Lot (Lot 0) and the individual lots, the Property, at the end of the auction, will have to decide whether to award the Complete Lot or the individual lots, based on the values reached, at its unquestionable discretion.

Extra-Time: If a user makes a bid in the last 5 minutes, the deadline will be extended by an additional period of 5 minutes and the countdown will restart, and so on until no offer is made in the last 5 minutes of extra-time. In the case of a maximum offer (proxy bid), automatic increments will be considered valid for extending the extra-time period.

The sale of the assets will be carried out in accordance with the physical condition in which they are found. It is highly recommended to visit the lots for sale.

All expenses caused by the disposal will be borne by the successful bidder, including collection and transport costs and any property transfer expenses. At no time are the Mandante or GOBID ESPAÑA SL responsible for the proper functioning, condition, MOTs (ITVs), etc., of the lots that make up the asset. To this end, their transfer will be carried out on an "as is" basis.

No type of post-sale warranty for non-conformity of the asset applies to the sale, so it cannot be claimed by any of the acquirers or interested parties.

Therefore, the existence of eventual damages or lack of quality in the assets sold shall not give rise to any extrajudicial or judicial action for compensation or redress.

Any liability of the Mandatario relating to the existence of third-party rights over the assets subject to the sale is excluded.

The sale is carried out with the obligation on the part of the buyer to assume their own expenses and responsibility for the purpose of checking their true conformity with the asset offered for sale.

Any liability to GOBID ESPAÑA SL derived from errors or inaccuracies in the translation of the texts and material published on the website is excluded.
