Deposit

To participate in the Auction, it is necessary to pay a security deposit of EUR 100,00.

The deposit must be made by bank transfer to the account specified below:

Reference: auction number and lot number

Interested users must consign the deposit described above before the end of the Auction.
Only once the deposit is received will the user be authorized to participate in the Auction.
To speed up participation in the auction, it is recommended to send proof of payment to [email protected]

Users who have participated in the Auction, but have not been awarded any asset, will receive their deposit back within 20 business days from the payment of the award amount. In the event that there is no award, it will be refunded within 20 business days following the conclusion of the auction.

If, after making the deposit and being awarded the lot on sale, the bidder does not complete the acquisition by paying the sale price and the Buyer’s Premium, said deposit will be retained.

In this case, the award will be assigned to the next best bidder who has made an offer equal to or above the reserve price.

Encumbrances

The sale of the assets is carried out free of charges and encumbrances.
However, all taxes, levies, and duties that are legally applicable related to the award or sale or transfer of each asset will be at the expense of and borne by the successful bidders or buyers. In the event that the vehicles have pending municipal IVTM taxes, these will be borne by the successful bidder.

Awarding of the lots

The sale will be carried out without being subject to a minimum price, although the Bankruptcy Administration reserves the right to reject the best offers if it considers them insufficient. For accepted offers, the specialized entity will send the provisional award confirmation to the successful bidder, who will be obliged to make the payment of the offered amount.

Warning: the Bankruptcy Administration reserves the right to communicate the winning bid to the Court for its approval. In this case, only once the offer is approved by the Court will the award confirmation be sent to the best bidder with instructions to make the payments within the scheduled deadlines.

Method of payment

All payments must be made entirely by bank transfer using the accounts communicated at the time of registration or together with the award communication (see general auction conditions).

Payment deadline

Payment of the award price of the lots must be made within 10 days from the award communication.

Payment of the Buyer’s Premium must be made within 5 days from the award communication.

Conditions for collection

In any case, collection must be completed no later than 0 days from the provisional award confirmation.
In order to optimize the collection service, GOBID ESPAÑA S.L. will communicate by email to the successful bidders the date and time to proceed with the collection of the lots. These dates may also be indicated on the auction website. In any case, GOBID ESPAÑA S.L. reserves the right to change the dates and times indicated for collection at its sole discretion.

If the successful bidder needs to carry out the collection on additional dates to those offered, they will have to pay an amount between EUR 250.00 and EUR 350.00 plus VAT for each added day, depending on the goods to be collected, as additional expenses.

Successful bidders must respect the proposed date. If you cannot make the collection on the communicated date and time, you may:

- upon approval, request that collection be allowed during the next auction attempt, if scheduled.

- upon approval, carry out the collection on days and times different from those initially proposed in the same sale phase, paying a further fee of between 250.00 euros and 350.00 euros plus VAT per added day and person needed for assistance, as additional expenses.

Failure to comply with the scheduled collection date between GOBID ESPAÑA S.L. and the successful bidder will result in a penalty of 350.00 euros applied to the latter if they have not notified the cancellation of the collection at least 48 hours before the appointment, without prejudice to the fact that, in any case, compensation for damages must be paid to GOBID ESPAÑA S.L.

Lots not collected within the established period will be subject to a daily penalty of 100.00 euros. In the event that the asset is not collected within 15 days after the last scheduled collection day, the sale will be considered resolved, and the amounts paid by the successful bidder (Awarded lots – Buyer’s Premium, complementary management expenses, and any complementary charges paid) will be retained as compensation for the prejudice caused.

GOBID ESPAÑA S.L. has no obligation to deliver any lot nor to organize in any way the collection and delivery thereof.

Collection operations must be carried out by the buyer in compliance with current safety regulations established by law; therefore, they will be obliged to make the necessary adjustments even when referring to third parties and/or collaborators employed in carrying out the aforementioned operations.

The successful bidder is responsible for any dismantling, moving, loading, and transporting of the awarded lots, and in the case of vehicles, also for the transfer of ownership and other corresponding procedures.

In any case, GOBID ESPAÑA S.L. will not make any lot available before the previous payments have been settled and, in the case of registered movable assets, before the corresponding transfer of ownership is completed.

Other specific conditions

Buyer’s Premium: a charge of 15,00% (plus 21% VAT, if applicable) on the award price of each lot, which will be added to it.
The Buyer’s Premium will have a minimum amount of 50 euros (plus 21.00% VAT, if applicable) for each awarded lot or combination (minimum commission).

Administrative expenses: These are the additional expenses that fall completely on the successful bidder, intended to cover the services and activities, performed and to be performed, necessary for the preparation, organization, and management of the sale of the assets at auction and the post-award phase. These expenses must be paid together with the payment of the buyer's premium according to the provisional award confirmation that will be issued once the auction is finished. If applicable, said expenses will be indicated in the file of each lot. In the event of awarding several lots, a reduction of said expenses may be agreed upon depending on the effective collection days and the service offered by Gobid.

Formatting of Computer Equipment: The successful bidder of the lot containing computer equipment must format the devices that require it before collection. The cost of formatting will be borne by the successful bidder, who must also prove that the equipment has been emptied in accordance with current regulations.

Decontamination of equipment/elements: In the event that any of the elements requires decontamination before collection, the decontamination process, as well as any other procedure necessary for its correct safety, dismantling, removal, and transport, in accordance with current regulations, will be the responsibility of the successful bidder, including the associated costs.

Adjudication Taxes: 21.00% VAT, which will be calculated on the award amount of each lot (if applicable).

Extra-Time: If a user makes a bid in the last 5 minutes, the deadline will be extended by an additional period of 5 minutes and the countdown will restart, and so on until no offer is made in the last 5 minutes of extra-time. In the case of a maximum offer (proxy bid), automatic increments will be considered valid for extending the extra-time period.

The sale of the assets will be carried out in accordance with the physical condition in which they are found, both regarding their physical configuration and their legal status. It is highly recommended to visit the lots for sale.

All expenses caused by the disposal will be borne by the successful bidder, including collection and transport costs, any property transfer expenses, notary fees, and any eventual cancellation in any public registry of the charges or encumbrances established on them. At no time are the Mandante or GOBID ESPAÑA SL responsible for the proper functioning, condition, MOTs (ITVs), etc., of the lots that make up the asset. To this end, their transfer will be carried out on an "as is" basis (cuerpo cierto).

No type of post-sale warranty for non-conformity of the asset applies to the sale, so it cannot be claimed by any of the acquirers or interested parties.

Therefore, the existence of eventual damages or lack of quality in the assets sold shall not give rise to any extrajudicial or judicial action for compensation or redress.

The buyer assumes at their own risk the condition in which the vehicles are found, without at any time being able to exercise any claim for any concept, including faults or defects, taking into account that they were collected from the street.

Any liability of the Mandatario relating to the existence of third-party rights over the assets subject to the sale is excluded.

The sale is carried out with the obligation on the part of the buyer to assume their own expenses and responsibility for the purpose of checking their true conformity with the asset offered for sale.

Any liability to GOBID ESPAÑA SL derived from errors or inaccuracies in the translation of the texts and material published on the website is excluded.
