Deposit
To participate in the Auction, a specific deposit must be paid for each lot.
The deposit must be made via:

The deposit must be credited before the end of the Auction. Only upon receipt will the user be authorized to participate. It is recommended to send proof of payment to info@gobid.es.
Privileged creditors related to real estate in this auction are exempt from paying the deposit for the lots on which they hold credit. To participate, they must send an email stating their position and submit the required documentation, excluding proof of deposit.
Participants who do not win any lots will receive a refund of the deposit within 20 working days after the end of the auction, without interest.
If the bidder does not complete the acquisition after being awarded a lot, the deposit will be withheld. In such a case, the lot will be awarded to the next best bidder whose offer equals or exceeds the reserve price.
Encumbrances and Liens
Assets will be delivered free of encumbrances or liens, except as noted below.
IMPORTANT: Mortgaged real estate guaranteeing third-party rights (lot 1) will be awarded with the charge in place. The awardee will retain the portion of the price equal to the guarantee. If the guarantee beneficiary is awarded the lot, they must only pay the difference between the award price and the guarantee, which will be extinguished by merger of rights.
Taxes, duties, levies, and other transfer costs will be borne by the buyer, including notarial, registration and all related costs. The insolvent company will not bear any sale-related costs. The buyer will also pay any outstanding Property Tax, urbanization costs, and community fees.
The Court will issue cancellation orders only after the Insolvency Administration provides proof of effective transfer. The buyer shall bear these costs.
Lot Awarding
If the winning bid equals or exceeds the reserve price, confirmation of award and payment instructions will be sent.
This does not apply to lots subject to rights of first refusal as specified in the clause “Assets Subject to Right of First Refusal”.
If the offer is below the reserve, the award must be approved by the Insolvency Administration.
The Insolvency Administration may submit the winning bid to the Court for approval. Confirmation will be sent only after such approval.
Participation Method
Users must register on www.gobid.es, enter their data, request auction registration, and accept the terms and conditions.
The data entered will be used to assign the award. All payments must be made by the registered user. Powers of attorney will be accepted only if authorized by the Principal.
The user must transfer the deposit, indicate auction and lot numbers, and send proof to info@gobid.es.
The deposit must be credited before the auction ends.
In addition to the deposit, users must send the following to info@gobid.es:

Valid ID
If married under community of property: spouse's ID copy (required in case of award)
IF COMPANY/ENTITY:
Deed of incorporation with authority
Valid ID of legal representative
Sworn translation if company is not Spanish
Notarized power of attorney if bidding via representative
Payment Method
The Buyer’s Premium must be paid by bank transfer to the account provided at registration or with the award notice (see general terms).
The provisional awardee must pay the total price plus VAT (if applicable) to the insolvent company’s account by the deadline.
Any transfer, notarial or cancellation costs must be paid before the formalization date. Once paid, ownership is transferred via notarial deed under the Principal’s conditions.
Payment Deadline
Buyer’s Premium: within 10 days of the award notice
Award price: within 10 days of the award notice
With prior authorization, the award price may be paid upon notarial sale formalization.
Transfer of Ownership
Ownership will be transferred via notarial deed, once the price, Buyer’s Premium, and all related costs are paid.
The formalization must take place within 30 days of award confirmation, extendable only by the Insolvency Administration.
The Principal will request the Court Clerk to cancel charges, liens and annotations. Costs will be borne by the awardee.
If the awardee fails to appear to sign, the Agent and Principal may consider the offer withdrawn. The Buyer’s Premium will be forfeited.
A fixed administrative cost (max. €300) is due, as listed in the lot file under “administrative costs”.
Other Specific Conditions
Buyer’s Premium: 4,00% + 21% VAT (if applicable)
Minimum Buyer’s Premium: €500 + VAT per lot

Assets Subject to Privileged Claims
Privileged creditors are not required to deposit. They may transfer the award. If awarded, they must pay the specialized entity’s fee.
Assets Subject to Right of First Refusal
For lots 1 and 2, right holders will be notified of the sale. If valid offers are received, they can match the best bid within 30 days. If they withdraw or fail to pay within 10 days, the lot goes to the best bidder.
Taxes on the Award
VAT and/or applicable taxes will be applied according to the buyer’s status and legal provisions.
Extra-Time
If a bid is placed in the final 5 minutes, the time extends by 5 minutes. This repeats until no more bids are made. Proxy bids count for this extension.
Condition of Assets and Waiver of Liability
Assets are sold as-is, both legally and physically. By bidding, the buyer accepts the urban and registry status.
It is recommended to inspect the lots.
All sale-related costs are borne by the buyer, including removal, transport, notarial, and cancellation fees.
Buyers waive any claim about the asset’s condition. Inspections can be scheduled.
Neither the Principal nor GOBID ESPAÑA SL are responsible for condition, ITVs, functionality, etc. Assets are sold "as a certain body".
No post-sale warranty is granted. No damages or defects will give right to compensation.
No liability is accepted for third-party rights on the goods.
The buyer must verify the conformity of the property.
