Deposit

To participate in the Auction, a specific deposit for each lot is required.

Lot 0 requires a deposit of EUR 12.440,00.

The deposit must be made via bank transfer to the following account:

ACCOUNT HOLDER: GOBID ESPAÑA S.L.

Reference: auction number and lot number

Interested users must make the deposit as described above before the end of the Auction. Only once the deposit is received will the user be authorized to participate in the Auction. To expedite participation, it is recommended to send proof of payment to info@gobid.es

Users who have participated in the Auction but have not been awarded any item will receive a refund of their deposit within 20 working days from the payment of the award amount. If no award is made, the deposit will be refunded within 20 working days from the close of the auction.

If, after making the deposit and winning the lot, the bidder does not finalize the purchase by paying the sale price and the Buyer’s Premium, the deposit will be retained.

In such case, the award will be assigned to the next highest bidder who has submitted a bid equal to or above the reserve price.

Encumbrances

The sale of goods is free of encumbrances and charges. However, all taxes, levies, and duties legally applicable to the award, sale, or transfer of each asset shall be borne by the awardees or buyers. It is noted that vehicles have outstanding municipal IVTM taxes that shall be borne by the awardee. The amount of outstanding tax is detailed in the lot sheet.

Lot Award

At the end of the auction, if the winning bid is equal to or higher than the reserve price, the award confirmation will be sent to the highest bidder with instructions for making the payments within the established deadlines.

If the winning bid does not reach the minimum or reserve price, the award must be approved by the Insolvency Administration.

Warning: the Insolvency Administration reserves the right to submit the winning bid to the Court for approval. In this case, only once the Court has approved the bid will the award confirmation be sent to the highest bidder with payment instructions.

Payment Method

All payments must be made entirely by bank transfer using the accounts provided at the time of registration or together with the award confirmation (see general auction terms).

Payment Terms

The payment of the lot award price must be made within 10 days from the award confirmation.

The Buyer’s Premium must be paid within 5 days from the award confirmation.

Withdrawal Conditions

In any case, withdrawal must be completed no later than 20 days from the provisional award confirmation.

If the asset is not collected within the indicated timeframe, the sale will be considered void and the amounts paid by the awardee will be retained (Awarded Lots – Buyer’s Premium, additional management fees, and any related charges paid) as compensation for the damage caused.

Withdrawal will be managed according to the conditions established by the Insolvency Administration and the bankrupt party. GOBID ESPAÑA S.L. is not obliged to deliver any lot or to organize, in any way, its withdrawal or delivery.

Withdrawal operations must be carried out by the buyer in compliance with current safety regulations. Therefore, the buyer is responsible for implementing the necessary precautions, including those involving third parties and/or collaborators involved in the operations.

The awardee is responsible for the dismantling, movement, loading, and transport of the awarded lots, and, in the case of vehicles, also for the transfer of ownership and any required procedures.

In any case, no lot will be made available before the previous payments have been received and, in the case of registered movable assets, before the transfer of ownership has been completed.

Other Specific Conditions

Buyer’s Premium: a charge of 13,00% (plus 21% VAT, if applicable) of the award price of each lot, to be added to it. The Buyer’s Premium will have a minimum amount of 50 euros (plus 21.00% VAT, if applicable) for each awarded lot or combination (minimum commission).

IT Equipment Formatting: The awardee of the IT equipment lot must format the devices requiring it before withdrawal. The formatting cost will be borne by the awardee, who must also certify that the equipment has been wiped according to current regulations.

Equipment/Item Decontamination: If any items require decontamination before withdrawal, the decontamination process and any other procedure necessary for safe removal, dismantling, and transport, in compliance with current regulations, will be the responsibility of the awardee, including all related costs.

Award Taxes: 21.00% VAT, to be calculated on the award amount of each lot (if applicable).

Offers on the Complete Lot: If no offers are received for the complete lot (Lot 0), the individual lots will be awarded, provided that they have received offers, as stated in the “Lot Award” section. If offers are received for both the Complete Lot (Lot 0) and the individual lots, the Insolvency Administration will decide, at its sole discretion, whether to award the Complete Lot or the individual lots, based on the values reached.

Extra-Time: If a bid is placed within the last 5 minutes, the deadline will be extended by a further 5 minutes, and the countdown will restart. This will continue until no bid is placed in the last 5 minutes of extra time. In the case of a maximum bid (proxy bid), automatic increments will be considered valid for the extension of the extra time period.

The sale of the goods will be carried out in the condition in which they are found, both physically and legally. It is advisable to visit the lots on sale.

All costs incurred from the sale will be borne by the awardee, including withdrawal and transport costs, potential ownership transfer fees, notary deed, and cancellation in any public registry of established encumbrances.

There is no post-sale warranty for non-conformity of the goods, and no claim may be made by buyers or interested parties.

Therefore, the existence of damages or lack of quality in the sold goods will not give rise to any extrajudicial or judicial compensation.

The buyer assumes at their own risk the condition of the vehicles and may not make any claims of any kind, including defects or faults, considering that the vehicles were recovered from public streets.

Any liability of the Seller concerning the existence of third-party rights on the items for sale is excluded.

The sale is carried out with the buyer's obligation to assume their own costs and responsibility for verifying the true conformity of the item offered for sale.

Any liability of GOBID ESPAÑA S.L. arising from errors or inaccuracies in the translation of the texts and material published on the website is excluded.

In case of any dispute concerning the interpretation of the provisions included in the general and specific terms published on the website and translated into different languages, the Spanish language version of such texts shall prevail.
