Deposit

To participate in the Auction, it is necessary to pay a deposit of EUR 6.000,00

Interested users must pay the deposit described above before the end of the Auction.
Only once the deposit has been received will the user be authorized to participate in the Auction.
To expedite participation in the auction, it is recommended to send proof of payment to info@gobid.es

Users who have participated in the Auction but have not been awarded any item will receive their deposit back within 20 business days from the end of the auction, without interest.
If, after making the deposit and being awarded the lot, the bidder does not complete the purchase by paying the sale price and Buyer’s Premium, the deposit will be retained.
In this case, the award will be attributed to the next highest bidder who has made a bid equal to or above the reserve price.

Encumbrances

The sale of the goods is carried out free of encumbrances, charges, taxes, levies, and duties. Any existing mortgages will not be transferred with the award of the lot and will be cancelled before or at the time of formalization.

The buyer will be responsible for IBI (property tax), Homeowners' Association fees, and any other taxes arising from the purchase that may apply to the year in which the sale takes place.

Lot Awarding

At the end of the auction, if the winning bid is equal to or greater than the reserve price, confirmation of the award will be sent to the highest bidder along with payment instructions and deadlines.

If the winning bid is lower than the reserve price, the award must be approved by the Seller at their sole discretion.

Participation Procedure

To participate in the auction, the user must register on the website www.gobid.es, enter their personal data, request registration for the auction, and accept its terms and conditions.

The user must deposit the required amount for participation in the auction into the bank account specified above.

The user must specify the auction number and the lot numbers they wish to bid on and simultaneously send proof of the bank transfer to info@gobid.es.

The deposit must be credited before the auction ends.

In addition to the deposit, the user must submit the following documentation to be authorized to participate in the auction, by sending it to info@gobid.es:

IF INDIVIDUAL:

• Copy of a valid ID of the person to whom the lot ownership will be transferred.

• If the bidder is married under a community property regime, they must also provide the spouse’s details, including a copy of their ID (this document is not binding for authorization to participate but is required in case of award).
  
  

IF COMPANY OR ENTITY:

• Copy of the company’s incorporation deed showing its formation and the powers granted to the bidder.

• Copy of a valid ID of the administrator or legal representative.

• Sworn translation of the deed of incorporation, if the company is not Spanish.

• Notarized power of attorney if participation is through a representative.
  
  

Payment Method

The Buyer’s Premium must be paid in full by bank transfer using the accounts provided at the time of registration or together with the award communication (see general auction terms).

The sale price must be paid by bank cheque or bank transfer on the day of formalization before a notary.

The costs for the property transfer, notarial deed, and registration must be paid simultaneously with the formalization of the sale.

Payment Deadlines

The Buyer’s Premium must be paid within 10 business days from the award communication and, in any case, always before the formalization of the sale.

The sale price and any other purchase-related costs must be paid within 30 business days from the award communication.

It is possible, with prior authorization from the Property, to pay the sale price at the time of formalization before a notary.

Ownership Transfer

The transfer of ownership of real estate will take place after or simultaneously with the payment of the sale price and purchase-related costs, by notarial deed, within a maximum of 30 business days from the award.

Administrative expenses, entirely borne by the successful bidder, are established to cover the sale formalization service, which will be organized by the Seller. These administrative costs will have a fixed amount not exceeding €300; the exact amount is specified in the lot details under "administrative costs."

Other Specific Conditions

Buyer’s Premium: The final successful bidder must pay the auction house fees set at: 8,00% of the final award price of each lot, plus 21% VAT (if applicable).

The Buyer’s Premium has a minimum amount of €500 (plus 21% VAT, if applicable) per lot (minimum commission).

The Buyer’s Premium is payable by the buyer or awardee, whether or not this is the secured creditor.

Award Taxes: VAT and/or any applicable tax will apply depending on the law and the winning bidder’s status.

Extra-Time: If a bid is placed in the last 5 minutes, the deadline will be extended by an additional 5 minutes, and the countdown will restart. This will continue until no bid is placed in the last 5 minutes of extra-time. In the case of a maximum bid (proxy bid), automatic increases will also be considered valid for triggering extra-time.

The sale of the assets will be made in accordance with their existing condition, both in terms of their physical state and legal status.

All costs related to the sale will be borne by the successful bidder: property transfer costs, registration, and notarial deed.

The successful bidders or buyers of any lot or asset expressly waive any claims regarding the condition of the asset. Interested parties who expressly request it will be allowed to inspect the condition of the assets included in the Lots on the dates previously established for this purpose. Under no circumstances shall the Seller or GOBID be held responsible for the operation, condition, inspections (ITVs), etc., of the items in the lot. The transfer will be made on an "as-is" basis.

No guarantee is provided after the sale due to non-conformity of the asset, and no claims may be made by buyers or interested parties.

Therefore, the existence of potential defects or lack of quality in the sold goods will not entitle the buyer to any extrajudicial or judicial claim for compensation or damages.

The Seller shall not be liable for any third-party rights over the goods offered for sale.

The buyer is solely responsible for verifying the compliance of the property offered for sale.

In case of insurgency of  any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website  translated in different languages, it will be applied the Spanish language version of such texts
