SPECIFIC TERMS AND CONDITIONS – MINI-AUCTION

Lot subject to the mini-auction: Property Registry No. 12.308 of the RP of Betanzos

Lot visit conditions: Visits are not allowed.


Deposit

The deposit must be paid before the start of the auction, as indicated in the official notification sent.

Users who participated in the Auction but did not win any lots will receive their deposit back within 20 business days from the conclusion of the auction, without interest. If, after placing the deposit and winning the lot, the bidder does not complete the acquisition by paying the purchase price and the Buyer’s Premium, said deposit will be withheld. In this case, the award will go to the next best bidder who has made an offer equal to or higher than the reserve price.


Encumbrances and Liens

The goods are sold free from liens, encumbrances, taxes, charges, and fees. Any mortgages will not be transferred with the lot and will be cancelled before or at the time of the finalisation. The buyer will be responsible for the IBI tax, Homeowners' Association fees, and any other purchase-related taxes attributed to the year of the sale. The seller will be responsible for the payment of any capital gains tax derived from the award.


Awarding of Lots

The best offer for the lot will be awarded.


Participation Terms

Only the highest bidder from Auction 25558 and admitted users who submitted an improved offer may participate. The user must register at www.gobid.es, enter their personal information, request registration for the auction, and accept its terms and conditions.

The data provided at the time of auction registration will be used for the award of the sale, the lots, and their ownership.

All required payments, before and after the sale, must be made by the registered users. Any powers of attorney will only be accepted with authorisation from the Principal.

Payment Terms

The Buyer’s Premium must be paid entirely via bank transfer using the accounts provided during registration or along with the award communication (see general auction conditions).

The purchase amount will be paid at the time of the transfer of ownership via public deed. In any case, payment must be made and confirmed before the date set for the transfer.


Payment Deadlines

The Buyer’s Premium must be paid within 10 days from the award communication.

The final bid price must be paid within a maximum of 20 days from the award communication.


Transfer of Ownership

The sale of real estate will be formalised via public notarial deed under the terms set by the Principal, only once the Buyer’s Premium and other purchase-related costs have been paid in full by the awardee.

Formalisation must occur within 20 days of the award confirmation notice; this period may be extended only by the Principal.

If the highest bidder fails to appear for the execution of the necessary documents for the transfer, the Principal, in agreement with the Mandate Holder, may consider the offer withdrawn. The Buyer’s Premium will be forfeited as compensation.


Other Specific Conditions

Possession Delivery LOT 1: From the formalisation date, the current occupant will have up to THREE MONTHS to vacate the property.

Buyer’s Premium: The final awardee must pay the auction house fee: 5.00% of the final awarded price of each lot, plus 21% VAT (if applicable).
The Buyer’s Premium is borne by the buyer, whether or not they are a partner of the selling company.

Taxes: VAT and/or any applicable tax under law and depending on the awardee will apply.

Extra-Time: If a bid is placed during the last 5 minutes, the timer is extended by another 5 minutes, resetting with each new bid. In case of proxy bids, automatic increments are valid for extra-time extension.

Awardees cannot make claims for the physical or legal state of the assets. All items are sold "as is", with the bidders waiving any rights of claim or price revision, including waiver of hidden defects under Art. 1.474 of the Civil Code.

Bidders accept the state of the assets, both physical and legal, and waive all claims. It is advisable to inspect the lots prior to bidding.

All disposal-related costs are the responsibility of the awardee, including removal, transportation, ownership transfer, notary fees, and any cancellation of public registry entries.

No post-sale guarantee applies regarding the conformity of the item, and no claims will be accepted.

The Mandate Holder assumes no responsibility for third-party rights over the auctioned goods.

The buyer must verify conformity of the asset on their own responsibility and cost.
