The present auction is subject to a deposit of

Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on Procedure's expenses.
Property transfer
The transfer of ownership will take place only after full payment of the hammer price, expenses and Buyer's Premium by notarial deed with Notary with Studio in the Province of Trento chosen by the Mandator
Payment deadline
Awarded lots have to be paid in full within 60 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 60 days from the provisional awarding.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Opozarjamo, da se premoženje prodaja v celoti, saj je bil sklenjen predhodni pogodbeni dogovor z dne 04/05/2022, ki je bil redno vpisan, in se nanaša na prenos v korist družbe v stečaju - že lastnice deleža 1/2 - ali tretjim osebam, ki jih je treba imenovati, preostali delež zemljišč, ki bo prenesen po dodelitvi.
Gradbene parcele v velikosti 12.425 m² spadajo v gradbeno območje, imenovano C3.2 Lu Gialdinu in spadajo v podobmočje C1.10 (člen 35 NTA Urbanističnega načrta Občine Santa Teresa Gallura) in so vsekakor območje, ki je predmet parcelacije z omejitvami in urbanističnimi pogoji, ki izhajajo iz uporabe predpisov, ki se nanašajo na podobmočje C1.10.
Stečajni upravitelj si pridržuje pravico, da sprejme in oceni ponudbe v višini, ki je nižja od zgoraj navedene osnovne cene do 25%.
Te ponudbe bodo ocenjene šele po koncu te dražbe po lastni presoji organov postopka, izključno v odsotnosti nepreklicnih ponudb v višini, ki je enaka ali višja od osnovne cene.
Za oddajo ponudbe pod zgoraj opisanimi pogoji, morebitni zainteresirani NE smejo slediti postopku "IZPOLNJEVANJE PONUDB NA OSNOVNI CENI DRAŽBE", temveč morajo poslati zahtevo na naslov pec gorealbid@pec.it, da se seznanijo z načini predložitve in prejmejo ustrezen obrazec ponudbe.
V vsakem primeru bodo nepreklicne ponudbe za nakup, predložene na podlagi zgoraj navedenih pogojev, podvržene uporabi kupnine poleg zakonskega DDV, kot je navedeno v splošnih in posebnih pogojih ter v obvestilu o prodaji v priponki.
