GOBID ESPAÑA SL: Manager of the online auction website http://www.gobid.es, headquartered in Málaga, Calle Esperanto no. 4, 29007, VAT: B72551898, authorized under a sale mandate for the sale of real estate – movable assets – intangible assets – business units.
Gobid.es: Trade name used by GOBID ESPAÑA SL
www.gobid.es: The website managed by GOBID ESPAÑA SL for asset sales.
Auction: Online sale of assets published on www.gobid.es
Call for Offers: Online sales notice published on www.gobid.es requiring the submission of an offer
Lot: Asset or group of assets subject to sale/auction
Registered User: A user registered on www.gobid.es
Sale/Auction Registration: Prior authorization required for the registered user to participate in the sale/auction
Bidder Number: Identification of the registered user
General Conditions: These Terms and Conditions which apply generally to all sales/auctions
Specific Conditions: Terms and Conditions specific to each individual sale/auction
Deposit: Amount required prior to participation in the sale/auction, when expressly stated
Base Price: Starting price of individual lots
Reserve Price: Minimum price below which the lot cannot be sold
Current Price: Current price of the lot
Simple Bid: Amount entered by the user to increase the current price of the lot
Maximum Bid (proxy bid): Maximum amount the user is willing to pay for the lot
Minimum Increment: Bids must be made in predetermined increments
EXTRA-TIME: Time allowed beyond the auction deadline for submitting new bids
Award: Declaration by GOBID ESPAÑA SL that a lot is sold to the highest bidder
Sale Price: Amount of the awarded lot at the close of the sale/auction
Buyer’s Premium: Percentage amount calculated on the sale price awarded in the sale/auction
These conditions apply generally to any use of the www.gobid.es website and specifically to the publication and conduct of Sales/Auctions, as well as the terms and conditions for participating users.
The specific conditions of each sale/auction shall take precedence over the present general conditions.
Sales/Auctions shall be published on the website www.gobid.es, specifying the start/end dates and the list of lots.
Each Sale/Auction is published on www.gobid.es under the terms and conditions in the General and Specific Conditions.
GOBID ESPAÑA SL reserves the right to cancel, extend, or suspend the Sale/Auction at its sole discretion.
The registered user expressly accepts all objective and subjective risks arising from participation in an online sale/auction and waives any liability claims against GOBID ESPAÑA SL for any resulting damages or losses.
GOBID ESPAÑA SL accepts no liability for damages caused to the registered user directly and/or indirectly, except in cases of willful misconduct or gross negligence.
It is not responsible for any damages caused by the user's own actions that impair functionality, visualization, or use of www.gobid.es before, during, or after the auction process.
In all cases not covered by these general terms, the website's terms of use shall apply.
A registered user must register for each Sale/Auction and accept the General and Specific Conditions to participate.
If a deposit is required, authorization to participate will only be granted by GOBID ESPAÑA SL after confirmation of receipt of the deposit.
Users who did not win any lot will receive a refund of their deposit within 20 business days after the close of the auction, with no interest.
Users who win one or more lots will be refunded the deposit once they have collected the acquired goods, settled any complementary service charges, and completed the acquisition, subject to prior authorization from the Mandator. The deposit may be deducted from service-related costs or other fees at the Mandator’s discretion.
If the deposit was paid via credit/debit card, the refund will be issued via bank transfer after the collection and completion of the acquisition.
The deposit will be retained if the payment terms for awarded lots are not fulfilled.
Bids for published lots may be submitted by registered and authorized users and are recorded within each lot listing on www.gobid.es.
Bids are always subject to validation and increment conditions.
GOBID ESPAÑA SL may cancel any bid if discrepancies arise between General and Specific Conditions.
Bids may be either static or dynamic (proxy bid):
Static bids are considered fixed-price offers.
Proxy bids are dynamic maximum offers and not visible to other users.
A static bid may be outbid, in which case the user must submit a new bid.
Proxy bids remain valid until outbid by a higher offer. Increments are automatic and based on predefined minimum values, up to the maximum amount set.
Bids will be accepted up to the deadline of each Sale/Auction. If bids are submitted within the last 5 minutes, the closing time will be extended as per each auction’s Specific Conditions.
In reserve-free auctions, users may bid the indicated amount or increase it using minimum increments or by entering a custom amount.
Bids are considered irrevocable.
If a bid is outbid, a new bid must be placed to remain the highest bidder.
At the end of each sale/auction, the provisional awarding phase begins, and a confirmation is sent to the highest bidder.
GOBID ESPAÑA SL may suspend or cancel the sale/auction or the award at its discretion.
Awarding is subject to receipt of the deposit (if applicable).
If the highest bidder fails to comply, the lot will be awarded to the next highest bidder, and so on.
Bids are binding and represent a formal commitment to purchase.
The winning registered user must comply with the Specific Conditions of the Sale/Auction, which define payment terms, collection, and penalties.
Failure to pay within the specified period will result in termination of the sale.
The user will forfeit the deposit (if applicable), which will be retained as compensation, and the award will be annulled.
Any damages discovered after lot collection will be the buyer’s responsibility.
GOBID ESPAÑA SL accepts no responsibility for total or partial errors in lot descriptions.
Each auction includes its own Specific Conditions detailing all relevant information.
Uncovered cases are governed by the website's terms of use.
Where not expressly regulated, applicable provisions of insolvency and civil procedural law shall apply supplementarily.
Lots are sold “as-is”.
A physical inspection is strongly recommended.
GOBID ESPAÑA SL and the procedure authorities are not liable for any errors or omissions in photos, descriptions, or other catalog details.
No post-sale warranties are recognized.
Buyers, by accepting these terms, waive any warranty or third-party claims against GOBID ESPAÑA SL or the authorities.
GOBID ESPAÑA SL is not liable for direct or indirect damages unless due to intent or gross negligence.
It is not responsible for technical issues, incorrect use of the website, or communication delays.
The auction may be suspended or postponed at the discretion of GOBID ESPAÑA SL or the Mandator for technical or other reasons.
System logs shall serve as full and exclusive evidence in all interactions.
These records are confidential unless required by law or judicial order.
In the event of interpretative discrepancies between translated versions, the Spanish version shall prevail.
