Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on Procedure's expenses.
Property transfer
The transfer of ownership will take place only after full payment of the hammer price, expenses and Buyer's Premium by notarial deed with Notary with Studio in the Province of Trento chosen by the Mandator
Payment deadline
Awarded lots have to be paid in full within 60 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 60 days.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Fiind vorba de un lot unic având ca obiect transferul proprietății complete, la adjudecare, dreptul de superficie menționat care grevează asupra p.f. 4097/5 se va stinge prin consolidarea nuda proprietății și a proprietății superficiale în favoarea aceluiași subiect.
Conform prevederilor PRG în vigoare din 02/12/2015, identificat ca "Variantă Generală la PRG — Martie 2015" aprobată de Guvernul Provincial prin hotărârea n. 2056 dd. 20/11/2015, zona în cauză este definită ca "P.A.G. 9", reglementată conform "Dispozițiilor particulare ale Planurilor Operative" prevăzute de art. 64 din normele de aplicare.
Prin hotărârea n. 2170 din 29/07/2021, Directorul Provinciei Autonome din Trento a autorizat tehnicienii administrației provinciale să acceseze terenurile de vânzare pentru a efectua operațiunile necesare redactării proiectului "Realizarea devierii pentru Sano în Mori (integrare); această autorizație este valabilă pentru o perioadă de doi ani, începând de la notificarea sau comunicarea acestui act.
Societatea falimentară (Fall. n. 19/2015) proprietară a celor 35.200 mp, a plătit deja Comunei taxe de urbanizare în valoare de aproximativ € 925.000,00.
Pe parcursul operațiunilor de vânzare, Mandantul își rezervă dreptul de a accepta oferte de valoare inferioară prețului de bază menționat, în limita de 25% (cu recunoașterea corespunzătoare a Buyer’s Premium). Acestea vor fi evaluate după încheierea licitației, la discreția organelor procedurii.
