Deposit

The present auction is subject to a deposit of  EUR 395.776,00.

Deposit has to be paid in one of the following ways:

In case of non-awarding of the good, the deposit will be returned within 25 working days from the auction deadline, without interest.
If the lot is awarded, the security deposit will be retained by the procedure as an advance on the sale price.


Lots Availability

Any registration related to mortgages and to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on buyer's expenses.

To this end, the Mandator will take charge of notifying the Delegated Judge so that the magistrate provides for the cancellation of the prejudicial transcriptions and registrations on the properties subject to transfer pursuant to art. 108 bankruptcy law

For further information relating to any abuses, violations, encumbrances or lack of conformity with the regulations in force of the lots for sale, please refer to the attached appraisal, including the specific indication of existing violations of any nature, including those relating to urban planning discrepancies, construction, cadastral and securities.

The release of the property does not concern the movable assets, equipment, furniture and anything else forming part of this sale; it will be the responsibility of the successful tenderer to proceed with the release of the property from the presence of such assets.

Payment deadline

Awarded lots have to be paid in full by Bank transfer within 90 days from the provisional awarding or by cashier's check in the notarial deed, to be paid within 90 days of the end of the sale.

Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.

Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full  within 90 days from the provisional awarding.


Buyer's Premium

A percentage of 1,50% charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law). 
 

Lot VAT: 
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)


In case of insurgency of  any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website  translated in different languages, it will be applied the Italian language version of such texts

It is identified in the P.R.G. as an area subject to monumental constraints and an architectural asset under protection L. 1089/1939.

The property is also identified in the P.A.T. as follows:
• Landscape constraint D.lgs. 42/2004 - Watercourses (Art. 2.1);
• Monumental constraint - D.lgs. 42/2004 (Art. 2.4).

The building complex is subject to:
• pre-emption regime, as cultural assets subject to constraints and specifically to the direct constraint in favor of the Ministry of Education (General Directorate of Antiquities and Fine Arts);
• establishment of a destination constraint in favor of the Veneto Region Regional Council
• building prohibition;
• perpetual and unlimited water intake servitude, pedestrian and vehicular access, perpetual building prohibition;
• establishment of a legal constraint in favor of the Ministry for Cultural and Environmental Heritage


Please note the presence of building, urban, and cadastral discrepancies, as described in the attached appraisal, particularly the building, urban, and cadastral discrepancies indicated on page 34 and following of the appraisal, with an explicit invitation to interested buyers to contact, through professionals, the competent municipal technical offices and the Superintendency, in order to verify all necessary compliance and the validity of titles, also based on the intervention project that is intended to be implemented, even in the case of transforming the building complex from hospitality to residential.
The real estate unit is free and not occupied by third parties with opposable title to the procedure.
Property burdened by constraints, servitudes, mortgages, and bankruptcy judgment, as well as subject to the pre-emption regime pursuant to D.Lgs. 42/2004, as better described on pages 41 and following of the attached appraisal.

Given the complexity of the procedures and the continuous evolution of regulatory frameworks, also considering the complexity of the structure in question, it is deemed essential for interested buyers, prior to participating in the public auction, to access the documents at the municipal technical offices in order to verify all necessary compliance and the validity of titles.

The sale includes the furniture, accessories, works of art, equipment, and other movable goods in general.

The release of the property does not concern movable goods, equipment, furniture, and anything else included in this sale; it will be the responsibility of the successful bidder to proceed with the release of the property from the presence of such goods.
