The present gathering is subject to a mandatory deposit of 10% of price offered, except for integration.

Lots AvailabilityAny registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on buyer's expenses.
Payment deadline
Awarded lots have to be paid in full within 90 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 20 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full at notarial deed.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Notes on compliance:
The following irregularities have been found: The approved land-use plan dated 13/09/2002 was followed by the signing of the agreement on 26/09/2002, deed recorded on 28/08/2002. The related urbanization works were tested by engineer Benedetti (for the secondary urbanizations of the I and II phases) and by architect Bergonzi for the remaining primary and secondary urbanization works of the I, II, III phases. From the testing by architect Bergonzi, an amount of € 98,062.56 remains unfreed, calculated on the 2002 costs indicated in the agreement. Given the circumstance that the executed works present critical issues in use (sewers in particular), as can be verified from the response of the Municipality of San Gemini dated 05/05/23, costs for regularization of the urbanization works and extraordinary maintenance are expected to be at least € 6,000.00 for each apartment, including the garage.
Estimated completion and maintenance costs: € 6,000.00
Notes: It is specified that the 2002 agreement provided in articles 4 and 9 that future buyers of the properties must assume all obligations undertaken and not fulfilled at the time of the alienation date. It is also specified that no new agreement was signed following the variation to the land-use plan approved on 01/10/2012. Therefore, the variation to the P.L. is to be considered as a suspended practice and awaiting the political-administrative determinations that will be deliberated by the City Council. As can be inferred from the response of the Municipality of San Gemini dated 05/05/23.
For the above reasons, urban planning compliance is NOT declared; notes: The lack of complete testing of primary and secondary urbanization works, together with the suspension of the variation to the Land-Use Plan, do not allow for the declaration of urban planning compliance.
