Lots Availability
 
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on buyer's expenses.

Payment deadline
 
Awarded lots have to be paid in full within 90 days from date set for property transfer.

Buyer's premium due has to be paid within 10 days from awarding.

Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 90 days from date set for property transfer.

The properties do not have an Energy Performance Certificate, therefore the costs for issuing them will also be borne on buyer's expenses.


Buyer's Premium
 
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law). 
 
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
 
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.


VAT: 
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)


In case of insurgency of  any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website  translated in different languages, it will be applied the Italian language version of such texts

With contract stipulated with private agreement dated 6/6/2018 with signatures authenticated by Dr. D'Andrea Maria Elisa, rep. n. 15398 collected. 10056, the then “F.LLI PIERANTOZZI S.R.L.” had leased the "branch" for a period of six years, from 06/15/2018 to 12/31/2024.
The rent, during the procedure, at the tenant's request, was reduced, by order of the Delegated Judge dated 11/25/2020, to 105,000 euros.
The art. 3 of the rental contract provides for tacit renewal upon expiry for a further six years unless canceled by registered mail. twelve months before the deadline.
The liquidator, with communication dated 8 November 2023, proceeded to cancel the contract so that, with effect from 1 January 2025, the "branch" will return to the availability of the procedure and its assignees.

The lot includes the movable property present inside as valued in the attached appraisal

It should be noted that a company branch lease contract is in place.

The building was built with the following authorizations:
• Building Permit: n. 194 of 07/12/2004 – building practice n. 1534/C,
• Usability: certificate n. 55/2007 building practice n. 1534/C
• Building Permit n. 97/2007 of 06/07/2007 for the transformation of the fourth floor-attic into a habitable surface L.R. 11.J 5/04 of 26/04/2004 subsequent amendments and additions); and additional usability assumed in the protocol of the Municipality of Tortoreto dated 02/04/2008 in the protocol. 7886.

The cadastral data and plans regarding the units making up the above lot:
• they differ from the actual state due to the construction on the north-east corner of the ground floor where a room serving the swimming pool was built
