If the auction participants are not awarded any goods, the deposit will be returned within 20 days from the auction deadline or sooner if expressly requested, without interest. The request must be sent in writing by email to the management info@gobid.es and must be approved by the Principal.
In the case of early return, the offer will be canceled and the right to award will be lost in the event of default by the first successful bidder.

If, in the event of an award, after having paid the deposit, the bidder does not complete the purchase, said deposit will be retained.

In this case, the award will be attributed to the following best successful bidder who will have made an offer for an amount equal to higher than the reserve price and who will not have requested the early return of the security deposit.

Charges

The sale of the Lots will take place free of any charge and encumbrance.
Despite this, all taxes and duties related to the award of each lot that are legally applicable, will be borne by the successful bidders, who will also have to pay notary, registration fees and any other related costs with the award. In no case will the bankruptcy company bear any type of expense related to the award. In addition, the buyer will be responsible for all suspended amounts that may exist relating to taxes on real estate and on those taxes and expenses accrued and not paid that affect the assets. Furthermore, to guarantee the obligation on the payment of taxes on the increase in the value of the Land (capital gains) that may have accrued, the successful bidder must deposit no later than the date on which the writing of the sale or transfer of ownership, a bank check of the amount of the capital gain in favor of the bankrupt company.

Lots awarding

At the end of the auction, users who have made the highest bid for an amount equal to or greater than the reserve price will be sent a confirmation of the award with instructions for making payments within the deadline.

How to participate

To participate in the sale, the user must register on the website www.gobid.es, entering their personal data, request registration for the auction, accepting the terms and conditions.

The data entered by the subject during registration on the site and at the auctions will be the same to whom the award will be attributed and to which the lots will be registered. All required payments, both before and after the sale, must be made by registered parties. Any powers of attorney or proxies may be taken into consideration with the prior authorization of the Principal.

The user must pay the required security deposit by bank transfer to the current account specified above.

The user is required to specify the auction number and the number of lots for which he intends to participate and at the same time send an accounting copy of the transfer made to the address info@gobid.es

The deposit must be strictly credited before the end of the auction.

In addition to crediting the security deposit, the user, to be enabled to participate in the auction, must provide the following documents by sending them to info@gobid.es

- IF AN INDIVIDUAL:

- Copy of a valid identity document of the person to whom the lot will be registered.
- If the bidder is married under a legal community of property regime, the corresponding data of the spouse must also be indicated, with the sending of the relevant copy of the identity document (document not binding for the purposes of qualification but required in case of award)

- IF COMPANY or BODIES:

- Certificate of the C.C.I.A.A. which shows the constitution of the company and the powers conferred on the bidder
- Copy of a valid identity document of the administrator or legal representative
- Any duly legalized translation of the chamber certificate, if the company is not Spanish.
- Special power of attorney received or authenticated by the notary, in case of participation through a representative

The combined provision of the deposit, the formalization of the auction registration - with express acceptance of the general and specific conditions of sale, published online on www.gobid.es - and the sending by the user of all the documentation requested in support, as specified above, will be considered equivalent to an irrevocable offer to purchase at the price set as the auction base or at the price indicated as the "minimum raise" in the lot sheet in the event of a free bid auction and will itself constitute a binding purchase commitment on the part of the user.

This offer will be formalized on the platform directly by the Assignee through an online bet, on behalf of the first user who will have completed the improvement procedure described above.

The Assignee will take care to inform all bidders in any way whatsoever of whether or not they are the best bidders when formalizing the aforementioned irrevocable purchase offer.

Formulation of bids

The offer, formalized for the first bidder, may be outweighed by bets of a higher amount, made by any authorized user.

The user who wants to be the best bidder (and therefore the provisional winner) must have made the highest bid at the end of the online auction.

Clearly, where there are more participants who make bids on the offer at basic auction price, even the user recognized as the "first bidder" will be able to compete for the award of lots by making bids on the current price.

To be able to win the lot(s) for sale, users will be invited to increase the price indicated in the auction (and, therefore, to make at least one raise) according to the methods indicated in the general conditions.

Payment method

The Buyer's Premium payment must be made entirely by bank transfer using the specified details or at the time of registration or upon receipt by the user of the award notification (see general conditions).

The payment of the adjudication price, together with any taxes, property transfer expenses, notarial deed and any cancellations from the public registers of charges or encumbrances, may be paid at the time of formalization of the public sale deed, according to the procedures established by the Principal

Payment deadline

The payment of the award price of the lots within 20 days of the award notification

The Buyer's Premium payment must be made within 10 days of the award notification

Property transfer

The transfer of ownership will take place only after full payment of the hammer price and expenses due by notarial deed according to the procedures established by the principal.

In addition, the property was acquired by the procedure through a property leasing contract with the Banco Bilbao Vizcaya Argentaria, SA (BBVA) entity on May 22, 2009, formalized through a notarial public deed. All the shares of the leasing transaction including the residual value have been paid, the transfer of ownership of the premises with the BBVA entity remaining suspended for formalization through public writing. Therefore, the registration and legal costs of the formalization of this deed will be borne by the successful bidder of this property.
The successful tenderer will have to assume both the registration and notary costs of the previous formalization and the registration and notary costs and any expenses arising from the new formalization in his name.

Finally, the Principal will undertake to notify the Delegated Judge so that he in turn will cancel the prejudicial registrations on the properties being sold. The cost of any cancellations will be borne by the successful bidders.

In case of failure to complete the transfer of ownership, the sale will be considered automatically resolved and the amount paid by the successful bidder as Buyer's Premium will be retained as a compensation penalty.

Other specific conditions

Buyer's Premium: A charge of 4,00 + VAT at 22% (where applicable) will be added to the hammer price of each lot.

The Buyer's Premium will have a minimum amount of € 50 (+ 22% VAT where applicable) for each of the lots present in the auction (minimum commission).

Even privileged creditors, in the event of an award, will be obliged to pay the Buyer's Premium.

Award Taxes: VAT and/or all those taxes that are applicable according to the legislation and the successful bidder will be applied.
