Creditors Agreement n. 2/2021 - Ancona Law Court
NOTICE OF SALE
"the launch of a competitive procedure pursuant to Article 163 bis I. bankruptcy aimed at identifying any other interested parties in the purchase and invites anyone interested to submit a specific Irrevocable offer to purchase the business unit, in compliance with this announcement, nevertheless taking into account the methods described below.
For the examination and resolution on the offers and / or for the tender between several possible bidders, the hearing on 25 January 2022 at 12:00 before the Delegated Judge Dr. Maria Letizia Mantovani at the Court of Ancona, Second floor Torre A.
In the event of a tender, the minimum raise is fixed in the amount of € 4,000.00 (four thousand).
The right of full ownership of the Company Branch is offered for sale, in SINGLE LOT, concerning the production and marketing of wooden floors (parquet), consisting exclusively of the following assets, liabilities and legal relationships:
- contracts with IPF customers pertaining to the Significant Activity, not executed;
- the brand (s), website and domains;
- all the permits issued to IPF necessary for carrying out the Relevant Activity, at the Fabriano headquarters;
- all absolute rights (including the right of ownership, the real rights of enjoyment and the real rights of guarantee) on all tangible assets (including in particular both equipment and machinery) - whether registered or unregistered - other than goods real estate, organized by IPF for the exercise and exercise of the Significant Activity;
- relations with IPF Employees.
The business branch is the same as in the business lease agreement and conditional irrevocable purchase commitment registered in Perugia on 1/20/2021 at number 1500 that those participating in the tender must declare to know the content.
The "basic sale price" is equal to 75,000.00 euros (seventy-five thousand / 00) and a deposit of at least 7,500.00 (seven thousand five hundred / 00) must be paid to participate in the sales competition.
The offers to buy the business branch must be presented in a sealed envelope at the Bankruptcy Chancellery of the Court of Ancona or must be received in a special sealed envelope, sealed and signed on the flaps, by registered mail from the State Postal Service with acknowledgment of receipt, at the office of the Judicial Commissioner Dott.ssa Cristiana Annibaldi, in Ancona Corso G. Mazzini.n.142 by 12.00 on the day before the hearing scheduled for the examination of the offers and the eventual competition between bidders. "
