SPECIFIC TERMS AND CONDITIONS

By submitting a bid, the bidder declares that they have fully read and fully accept these terms of sale and all documentation made available. If a notice of sale is attached to the auction lot/advertisement, by submitting a bid the bidder declares that they have read and accept the conditions stated therein, of which these terms of sale are to be understood as an extract. The bidder further declares that they have examined and accepted all documentation made available for the purposes of participation

Deposit

The auction is subject to a security deposit of EUR 1.000,00.

Lot 0 requires payment of a deposit of EUR 22.000,00

Lots with a starting value equal to or greater than EUR 10,000.00 require payment of a specific security deposit indicated in the respective lot descriptions.

The security deposit must be credited before the auction ends.
Once the deposit has been credited, the user will be enabled to participate in the auction.
To expedite participation in the auction, users are advised to send a scanned copy of the payment receipt showing the CRO code to: [email protected]

If auction participants do not win any items, the security deposit will be refunded within 20 working days of the auction closing date, without interest.

If, after winning an item and paying the security deposit, the bidder fails to complete the purchase, the deposit will be retained.

Availability of Lots

Any registrations relating to pre-emption rights, registrations of attachments and precautionary seizures, and any other encumbrances on the assets offered for sale, will be cancelled pursuant to Art. 217, paragraph 2 of the C.C.I.I. once the sale has been completed and the price has been paid in full. All cancellation formalities shall be carried out at the successful bidder's expense.

All costs relating to transfers of ownership, including any transfers required more than once and the related charges, shall be borne by the successful bidder

In the event of the export of registered movable assets, the purchaser must carry out the required procedures in compliance with current legislation. Please note that, for the purposes of deregistration for export, vehicles must be in compliance with statutory inspection requirements as of the date of the request.

Payment method

All payments must be made exclusively by bank transfer. The relevant details will be provided either at the time of registration or when the user receives notification that they have won (see general terms and conditions).

Payment deadline

Lots won must be paid for within 5 days of confirmation of the provisional award.
The Buyer's Premium and any ancillary management charges, where applicable, must be paid within 5 days of confirmation of the provisional award.

Collection of lots won
 
The purchaser may collect the lots won only after payment of the winning bid price and the applicable commissions (Buyer's Premium, ancillary management charges) has actually been received.
 
In any event, collection must be completed no later than 30 days from the provisional award.
 
In order to optimize the collection service, GOBID INTERNATIONAL AUCTION GROUP SRL will notify successful bidders by email of the date(s) and a time during which they may collect the lots. These dates may also be indicated on the auction webpage. GOBID INTERNATIONAL AUCTION GROUP SRL reserves the right to change the stated collection dates and times at its sole discretion.
 
If the successful bidder collects the lots on dates other than those communicated, they must pay an additional charge of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected.
 
Successful bidders must comply with the start date of the collection operations. If the successful bidder is unable to collect on the day and at the time communicated, they may:
 
-  subject to approval, request permission to attend during the date(s) scheduled for the subsequent sale attempt, if applicable.
 
-  subject to approval, collect on days and at times other than those made available for the relevant sale attempt, paying an additional charge of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected
 
Failure to comply with the collection date scheduled between GOBID INTERNATIONAL AUCTION GROUP SRL and the successful bidder will result in a penalty of EUR 350.00 being charged to the successful bidder if the failure to collect is not reported at least 48 hours before the appointment, without prejudice, in any event, to GOBID INTERNATIONAL AUCTION GROUP SRL's right to recover any greater loss suffered.
 
All lots not collected by the deadline indicated above will be subject to a daily late fee of EUR 50.00. If the goods are not collected within 30 days of the collection deadline, the sale will be automatically deemed terminated and the amounts paid by the successful bidder (lots won, Buyer's Premium, ancillary management charges and any additional charges paid) will be retained as liquidated damages. 
 
GOBID INTERNATIONAL AUCTION GROUP SRL is not required to deliver any lot or to arrange collection of the lots in any way. 
 
The purchaser must carry out collection operations in compliance with the safety regulations in force under law; the purchaser is therefore required to make any necessary adjustments in this regard, including with respect to any third parties and/or contractors engaged to carry out those operations.
 
The purchaser is responsible for any dismantling, handling, loading and transportation of the lots won, and must leave the areas affected by collection in a safe condition and free of any goods and/or waste materials generated by the purchaser during the aforementioned operations. In the case of registered movable assets, the purchaser is responsible for completing the procedures required to carry out the necessary transfers of ownership. 
 
Transfers of ownership must therefore be carried out at the successful bidder's expense by the vehicle registration agency designated by the bodies overseeing the proceedings, or, alternatively, by an agency designated by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
In the event of the export of registered movable assets, the purchaser must carry out the required procedures in compliance with current legislation.
 
In any event, GOBID INTERNATIONAL AUCTION GROUP SRL will not make any lot available until the aforementioned payments have been credited and, in the case of registered movable assets, until the relevant transfer of property.
Other specific terms

Buyer's Premium: A charge of 10,00% + VAT will be added to the hammer price of each lot.

The Buyer’s Premium shall be subject to a minimum amount of €25 (+ 22% VAT where applicable) on each lot or combination awarded, as a minimum commission.

Ancillary management charges: These are ancillary costs borne entirely by the successful bidder, intended to cover the services and activities, carried out and to be carried out, necessary for the preparation, organization and management of the sale of the auctioned goods and the subsequent award phase. These expenses must be paid at the same time as the buyer's premium due, as indicated in the provisional award confirmation that will be issued after the auction ends. Where applicable, these charges will be indicated in each lot's listing.

VAT: VAT at 22,00% of the sale price will be calculated on the hammer price of each lot. (where applicable)

Extra-Time: if a winning bid is placed within the 5 minutes preceding the auction's closing, the time available to place another bid will be extended by a further 5 minutes from the last bid received. This will continue indefinitely: for every winning bid received within the 5-minute extra-time period, the time available to place another bid will be extended by a further 5 minutes from the last bid received.  Automatic bids placed in response to a maximum bid (proxy bid) will also be considered winning bids.

Bids on the Entire Lot: If no bids are received on the entire lot (Lot 0), the individual lots and/or combinations will be awarded.
If bids are received on the entire lot (Lot 0), at the end of the auction the bodies responsible for the proceedings reserve the right to award or not award this lot, based on the values reached by the individual lots.

Lots are sold as seen and approved in their current condition. Inspection is recommended.

The sale of the goods is a forced sale (Art. 2919 of the Italian Civil Code), and the goods are sold as seen and approved in the factual and legal condition in which they are found. In a forced sale, no warranty is given for defects in the goods. The sale may not be challenged on grounds of damage. (Art. 2922 of the Italian Civil Code).

Consequently, the existence of any defects, lack of quality or discrepancies in the item sold shall not give rise to compensation, indemnity or a reduction in price.

The Agent shall have no liability whatsoever with regard to the existence of third-party rights over the goods being sold (Art. 2920 of the Italian Civil Code).

The sale is made with the successful bidder bearing the obligation and responsibility to verify that the goods comply with safety regulations.

In the event of any disputes concerning the interpretation of the provisions contained in the general and specific terms displayed on the platform, which may have been translated into other languages, the Italian version of the text shall prevail.
