Collection of Awarded Lots

The buyer may collect the awarded lots only after the award price and the applicable commissions (Buyer's Premium, ancillary management charges) have actually been received.

In all cases, collection must be completed no later than 30 days from the provisional award.

In order to optimise the collection service, GOBID INTERNATIONAL AUCTION GROUP SRL will notify successful bidders by email of the date(s) and a time at which they may collect the lots. These dates may also be indicated on the auction webpage. GOBID INTERNATIONAL AUCTION GROUP SRL reserves the right, in all cases and at its sole discretion, to change the indicated collection dates and times.

If the successful bidder collects the lots on dates other than those communicated, they must pay an additional fee of between EUR 250.00 and EUR 350.00, plus VAT, per day, depending on the quantity of assets to be collected.

Successful bidders must observe the date on which collection operations begin. If the successful bidder is unable to collect on the communicated date and at the communicated time, they may:

-  subject to approval, request permission to attend during the date(s) scheduled for the next sale round, if applicable.

-  subject to approval, collect on days and at times other than those made available for the relevant sale round, by paying an additional fee of between EUR 250.00 and EUR 350.00, plus VAT, per day, depending on the quantity of assets to be collected.

Failure to comply with the collection date scheduled between GOBID INTERNATIONAL AUCTION GROUP SRL and the successful bidder shall result in a penalty of EUR 350.00 being charged to the successful bidder if the failure to collect is not notified at least 48 hours before the appointment, without prejudice, in all cases, to GOBID INTERNATIONAL AUCTION GROUP SRL's right to claim compensation for any greater loss suffered.

All lots not collected by the above deadline shall incur a daily late fee of EUR 50.00. If the asset is not collected within 30 days of the collection deadline, the sale shall be automatically rescinded and the amounts paid by the successful bidder (awarded lots, Buyer's Premium, ancillary management charges and any additional fees paid) shall be retained as a penalty by way of compensation.

GOBID INTERNATIONAL AUCTION GROUP SRL is under no obligation to deliver any lot or to arrange collection of the lots in any way.

Collection operations must be carried out by the buyer in compliance with applicable statutory safety regulations; the buyer shall therefore be responsible for making any necessary adjustments in this regard, including with respect to any third parties and/or contractors engaged to carry out such operations.

The buyer is responsible for dismantling, handling, loading and transporting the awarded lots, where applicable, and must leave the areas affected by collection in a safe condition and free of any goods and/or waste materials generated by the buyer during the aforementioned operations. In the case of registered movable assets, the buyer shall be responsible for completing the procedures required to carry out the necessary transfers of ownership.

Transfers of ownership must therefore be carried out at the successful bidder's expense through the vehicle registration agency indicated by the bodies responsible for the proceedings, or alternatively, by GOBID INTERNATIONAL AUCTION GROUP SRL.

In the event of the export of registered movable assets, the buyer shall carry out the required procedures in compliance with applicable law.

In all cases, GOBID INTERNATIONAL AUCTION GROUP SRL will not make any lot available until the above payments have been credited and, in the case of registered movable assets, until the relevant transfer of ownership has been completed.

Other specific terms

Buyer’s Premium
: A charge of 15,00% + VAT will be added to the hammer price of each lot.

The Buyer’s Premium shall be subject to a minimum amount of €25 (+ 22% VAT where applicable) on each lot or combination of lots awarded, as a minimum commission.

Additional handling fees: These are additional costs borne entirely by the successful bidder, intended to cover the services and activities, performed and to be performed, necessary for preparing, organizing and managing the sale of the goods at auction and the subsequent award process. These fees must be paid at the same time as the Buyer’s Premium due, as set out in the provisional sale confirmation to be issued after the auction closes. Where applicable, these fees will be indicated in each lot’s description.

VAT: VAT at 22,00% of the sale price will be calculated on the hammer price of each lot (where applicable).

Extra time: if a winning bid is placed within the 5 minutes before the auction closes, the time available to place another bid will be extended by a further 5 minutes from the last bid received. This process will continue indefinitely: for every winning bid received during the 5-minute extra-time period, the time available to place another bid will be extended by a further 5 minutes from the last bid received.  Automatic bids in the event of a maximum bid (proxy bid) will also be considered winning bids.

Lots are sold as seen and accepted in their current condition. Inspection is recommended.

Any adjustments required to bring the goods into compliance with all applicable regulations, particularly those concerning accident prevention and safety, as well as environmental protection and, more generally, applicable regulations, shall be the sole responsibility of the purchaser, who shall bear all related costs, with the transferor released from any liability in this regard. Any equipment that does not comply with the regulations currently in force, if included in the inventory, shall be deemed to be sold solely as spare parts, and the receivership shall bear no liability in the event that the transferee uses such equipment. In particular, for any goods that do not comply with safety regulations or lack the CE mark, the successful bidder shall be required, at their sole care, expense and risk, to bring them into compliance or, if this is not possible, to dispose of them in accordance with the law.

The sale of the goods is a forced sale (Art. 2919 of the Civil Code); the goods are sold as seen and accepted in their actual and legal condition. In a forced sale, no warranty is given against defects in the goods. The sale cannot be challenged on grounds of damage (Art. 2922 of the Civil Code).

Consequently, the existence of any defects, lack of quality or non-conformity in the goods sold shall not give rise to compensation, indemnity or a reduction in price.

The Agent shall bear no liability whatsoever with regard to the existence of third-party rights over goods offered for sale (Art. 2920 of the Civil Code).

The successful bidder shall be responsible for and bear the cost of verifying that the goods comply with safety regulations.

In the event of any disputes concerning the interpretation of the provisions contained in the general and specific terms set out on the platform, which may have been translated into other languages, the Italian version of the text shall prevail.
