By submitting the bid, the bidder declares to have fully reviewed and to fully accept these conditions of sale and all documentation made available. If a sale notice is attached to the auction sheet/listing, by submitting the bid, the bidder declares to have reviewed and to accept the conditions set out therein, with respect to which these conditions of sale are to be understood as an extract. The bidder further declares to have examined and accepted all documentation made available for the purposes of participation

Deposit

The user must pay the security deposit (equal to 10% of the offered price) and the expenses advance (equal to 5% of the offered price) by a single bank transfer (equal to 15% of the offered price) to the current account in the name of the Procedure:

The deposit must be mandatorily credited before the deadline of the collection.

To speed up participation in the auction, the user is advised to send a scanned accounting copy of the payment made with the CRO code to: [email protected]

Non-winning participants will be refunded the security deposit on the Buyer’s Premium paid, by bank transfer, within 20 working days from the final auction deadline, without interest. 
The Liquidator Commissioner shall also refund non-winning participants the deposit and expenses advance paid for participation in the auction, without interest.

If, in the event of award, after paying the deposit, the bidder does not complete the purchase, said deposit will be retained.

Participation rules

The collection will be carried out using the following methods:

All potential bidders, except parties not permitted by law to purchase, after registering on the website www.gobid.it, will be required to send an irrevocable purchase offer for any amount, by completing the participation form 'Annex B' (published online) and returning it signed, to accept the proposed conditions, to the following address:

together with the bank transfer receipt proving payment of the required security deposit.

The irrevocable purchase offers submitted by potential buyers must be accompanied by payment of the required security deposit, whose payment will itself constitute a formal commitment to purchase by the signer of each offer.

The best offer received at the certified email address provided by the Agent may be used as the auction base for a competitive sale experiment to be held on the Platform.

The Agent shall inform all bidders by any means whether or not they are the best bidders upon formalization of the aforementioned irrevocable purchase offer.

The Principal reserves, at its unquestionable discretion, the right to accept or not the irrevocable purchase offers submitted by potential buyers. Offers deemed not adequate may therefore be refused by the Principal, without costs charged to the Procedure.

In the event of acceptance of the best offer, the Principal shall instruct the Agent to carry out the subsequent sale, to be held by online auction on the basis of the best offer received and whose specific conditions are set out below.

Offers must be made according to the methods indicated in the attached offer form and must contain:
 
- the identification of the bidder, with complete indication of personal details and details of an identification document, the indication of the tax code and, in the case of a married natural person, the property regime existing between the two spouses;
- the CCIAA registration report of the company or of the sole proprietorship and an identification document of the legal representative in the case of a legal person or of the owner in the case of a sole proprietorship;
- the offered price

Completion of the form will entail acceptance of the terms of use of the platform www.gobid.it and of the general and specific terms of the collection and of any subsequent auction.

- Exclusively online timed auction (PHASE 2) 

Payment method

All payments must be made exclusively by bank transfer. The details will be specified either at the time of registration or upon receipt by the user of the award communication (see general conditions).

Payment deadline

The lots awarded by the user must be paid within 5 days from the end of the sale. (see general auction conditions)


Collection of awarded lots

Collection of the awarded lots by the buyer may take place only after actual receipt of payments of the award price and the expected commissions (Buyer’s Premium, ancillary management charges).
 
In any case, collection must be completed within and no later than 30 days from provisional award.

Other specific conditions

Buyer's Premium: A charge of 15,00% + VAT will be added to the hammer price of each lot.

The Buyer’s Premium will have a minimum amount of €25 (+ 22% VAT where applicable), on each of the lots or awarded combinations, as minimum fees.

VAT: VAT at 22,00% of the sale price will be calculated on the hammer price of each lot. (where applicable)

Extra-Time: if a winning bid is placed within 5 minutes before the auction closes, the time available to place another bid will be extended by a further 5 minutes from the last bid received. And so on, for each winning bid received within the 5 minutes of extra time, the time available to place another bid will be extended by a further 5 minutes from the last bid received. Automatic bids in the case of a maximum bid (proxy bid) will also be considered winning bids.

The lots are sold as seen and approved in the condition in which they are found. Viewing is recommended.

The sale of the goods is understood to be forced (Art. 2919 c.c.) and is arranged for the goods as seen and approved in the factual and legal state in which they are found. In a forced sale, the warranty for defects of the item does not apply. It cannot be contested on grounds of damages. (Art. 2922 c.c.).

Consequently, the existence of any defects or lack of quality or non-conformity of the item sold cannot give rise to compensation, indemnity or reduction of the price.

Any liability on the part of the Agent regarding the existence of third-party rights over the goods subject to the sale is excluded (Art. 2920 c.c.).

The sale takes place with the obligation and burden on the successful bidder to verify their compliance with safety regulations.

In the event of any disputes arising relating to the interpretation of the provisions contained in the general and specific conditions set out on the platform, possibly translated into other languages, the Italian version of the text shall prevail.
